Its up to the ref to award the foul, if not then play on, otherwise whats the point in having a ref at all?

I'm sorry but if the ball is put out everytime a player stays down it would be hard to get a decent game of football going. It's up to the referee to stop play if he deems the injury serious enough to warrant it.
The rules say intent is enough and he certainly intended to clatter into Ballack just then.
