I think the key point you are missing is there has to be an "accident" in order for him to leave the scene or tell the police.

depends what you think constitutes an accident, or rather what the police think.

my situation years back was a car coming in the opposite direction crashed after they passed me (at least 100 yards) in the other direction. Their "accident" was the thing which is important. The fact your vehicle has no damage (and neither did mine, as we never touched) had no bearing. All it took was a witness to say I was there at the time and then drove off I got done.
 
I have approached round a corner and she has darted across the road in front of me. As I have approached her she has started mouthing off at me so I just carried on driving towards her at about 20/25 mph (she's standing still in the middle of the road) and then I've gone over the white lines onto the other side of the road and around her.

So, basically you drove like a tool?

Can't imagine they can convict on that evidence. Without any indication on your car of the impact I can't see that it'll stick.
 
To the OP, if you were only doing 20/25 mph then you would have had plenty of time to stop. It sounds like a bad decision to go around her regardless of whether it was her own fault. However, if you genuinely didn't hit her, and assuming there is no evidence to the contrary, then it is unlikely to go further. It really depends on whether there are witnesses or what they see on any nearby cameras. If there is such evidence then I'd imagine you'll have to explain yourself in court.

Ill be honest I tend to just keep going at people who wonder into the road as well, its natural selection, they choose to wonder infront of 1250kgs of metal travling at speed, they accept the consequences of their actions.

Then you'd end up in court. Again, regardless of whether it is the pedestrians fault, you would be expected to try and stop. How do you know the person in the road isn't impaired in some way (e.g. deaf, didn't hear the car coming, partially blind, mentally challenged, whatever).

Yeah, I wasnt able to stop, they just walked straight out in front of me.
When I put the brakes on after I hit them, it kind of squashed them a bit more.
 
Had a call from my insurers yesterday saying she has put a claim in for personal injury.

I can see what this is all about now. Unbelievable.

Surely she can't claim for personal injury when the incident is still a mother fudging allegation!!!!!!!! OMFG

Tell me where this woman lives and I'll show her a personal injury, MY FIST AND HER FACE!
 
It's a scam.

You wait she will produce more witnesses than Jesus had disciples.

My sister had similar incident a few years ago, no witnesses at the time, a few weeks later insurer contacted my sister, then witnesses appear who turned out to be friends & family members, insurers threw claim out, but police took action against the person & others .
 
How is this going any further? Surely your insurance company should protest this as she has no proof that you hit her.
If I were you I would tell them to let it go to court. The 3rd party would/will give your insurance solicitors the proof they have (if Im not mistake they must do) which is absolutely nothing. Then they will dismiss the claim. Take it to court. The women will get in big trouble for wasting police time and may even get a fine.
Refuse to back down if you are more than likely to win. I cant see how she can win as she has nothing but a scratch that she probably got from falling over her own bull doodoo.

I'm ******** it about the police side of it as the offences are very serious. Whilst I have a clean license should I lose it I'd lose my job instantly. There is no way it can be proved I hit her as far as I can see.

The copper checked my car and there was not a mark on it. If I'd have hit her at the speed she says I'd have had the airbags deploy surely?

As for the claim, unless she has witnesses, which she told the police she hadn't then I can't see how she'd be successful in court.

Airbags may have deployed depending on the speed, G force of the impact and other factors. Only problem is that you could have sorted this out before the police came.

As you say she said she has no witness but this may change. Local paper may ask for someone to come forward. Her only problem then is that a witness may have seen exactly what happened which is you not hitting her therefore leaving her to explain to the police why she is not stating the truth.

All I can say is Karma. Hopefully she'll get whats coming to her.
 
Well I cant see a problem. Has your insurance company sent anyone to inspect your car? If they havent then I would ask them to send someone. They should be able to tell if anything has been corrected such as paint, dents or any other damage.
