My point is that if he had been doing what she said, and she still ran out into the road, she was going against everything I have ever been taught when crossing a road.
 
Yes... Think of the timing involved. For the car to be that close, at that speed, there is no way you would not hear it.

Perhaps my hearing is just a bit more acute than some peoples.
 
Whatever the fact and events make sure you have your day in court.

I had a similar but different (?) issue just over 2 years ago.

I was driving into a parking space and was hit from there rear (caught my nearside rear) and spun me so drivers side roated 90 deg and hit a parked car. The lady who hit me decided at first I had reversed in to her a high speed, then when those facts did not pan out she then said my car was parked across the road at 90 deg to oncoming traffic and she drove into me as there was no where else to go. She stuck to this story for 17 months.

Police took statements at the scene but decided, as there were no injuries and medical attendance was not required, it was an insurance matter only.

The lady then started claiming personal injury, time off work etc etc, but because I knew I was completely in the right I defended myself against her claims and it went to court (some 17 months later) and on the day of the hearing when confronted will the evidence (by her own lawyers) she backed down said "OK my fault" before we went into the court room.

Took me just over 18 months to get my NCB and excess back but was worth it. and her insurer got hit with the cost for my car, excess, parked car and small wall that I was forced into.

Different scenario from OP but like I say, If you are 100% sure you are right then I would defend your actions to the hilt.

Quite a story, feel for you OP and how easy such a thing is to fabricate (shoudl it have happened as you say).

A good example case for justifying a roadhawk or camera, but then again such a thing would most likely be confiscated and used against you some way :rolleyes:
 
Has nobody looked at it from the pedestrian point of view ?

The impression of the incident I have gleaned from the OP is...

The pedestrian is (legitimately) crossing a side road precisely where they should cross the road. Car turns into side road and does NOT give way scaring the bejesus out of pedestrian.

Yes a car/motorised vehicle MUST give way in this scenario, that's what that single broken white line means. (If the pedestrian is already crossing when you arrive)

Remember..It is a PUBLIC HIGHWAY not a CAR road.

Of course it is a bit rough she's put in this claim against you but I bet you don't do that again huh ?

I'd have simple given you the "You twathead" look !!

It wasn't a side road, he was going round a corner, same road.
 
Hopefully the judge will see sense, 30-50mph and a graze?

I've been hit off my old ped at 15mph and I can tell you, I had a few more injuries than a graze!

-Multiple large patches of bruising
-open cuts which required stitching
-fractured cocyx (is that how you spell it)

Mind you, I did my best 'I believe I can fly' move when it happened :D

I got hit by a car turning into a side road once, i went up onto the bonet, smashed the windscreen, massive cut on my head and bruised like a peach. cant have been going more than 15mph, hurt like a mother.

Mate of mines dad got knocked off his bike at ~20. Would have died if not for the helmet they said

The absolute tool that hit me didnt have any lights on at this time of year about 8ish at night, Didnt see him untill my face was mashed against his windscreen.
