I was under the impression that they cannot refuse to refund for faulty goods. I've always stood my ground, and eventually they cooperate.

Sale of Goods act - check the DTI website.
They can't refuse a refund especially as they can not offer a decent replacement or repair. They have no legal grounds to refuse a refund at all.

http://www.dti.gov.uk/ccp/topics1/facts/salegoodsact.htm

Key Facts:

• Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

• Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.

• Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.

• It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.

• If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)

• For up to six years after purchase (five years from discovery in Scotland) purchasers can demand damages (which a court would equate to the cost of a repair or replacement).

• A purchaser who is a consumer, i.e. is not buying in the course of a business, can alternatively request a repair or replacement.

• If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit

Thanks for that link Virii, if the manager tells me the same as the assistant, then I will agree with him and print off as much info about the matter and go and make the pair of them look stupid in front of all there customers. :)

Well, I have taken back a second hand PS2 there before (long story, basically I was desperate for a PS2 cause mine broke, and second hand is all they had). Afer taking back the 3rd faulty PS2 they had, I asked them to go in to th back and check it. And then after that I got a full refund.

Ask them to check the console, having said that, they might be noobs and not know what an atifact is :/

"2nd Update"

Well I just spoke to the manager and he gave me the same line as his assistant, "im sorry but we dont offer exhange on consoles" so I asked him what he suggested.
Phone up Microsoft he told me they will have it exhanged in 48hours, yeah right I said more like 2-3 weeks.

So I told him that I had been researching around trading standards and read off a few paragraphs about consumers rights and hes now said I can have a refund, what a suprise. :)

Gotta give them credit for trying.

And just as I wrote this, I had a phone call back and hes just recieved stock so I can get a replacement this afternoon, did he have the replacements there all along, I'll let you decide. :)

Yeah buggers are dropping like flys now, ive only had mine since Tuesday, longest ive been on it was last night for about an hr, i getting to the satge now where i daren't put it on in case it goes.

Mine's been on for hours at a time and no problems so far thankfully.

Having said that, I rarely play one game for more than an hour at a time. (also most of the time I just play the Xbox Live Arcade games)

Must admit when ive been playing on it, i keep glancing to make sure ive got no red lights appearing, and the only reason i stopped playing on it last night after an hr for was because i thought i better give it a rest in case it goes. :( im well paranoid about it going now.

My nephews and my mates's one are still going, and they use them for hrs, but i think that theres that many going that it could be mine next at any time.

I play mine for hours on end the way I look at it is if its going to break I would prefer it to go ASAP and then get a replacement rather then play for a little time and if it is going to break I wont find out for ages.

Yeah thats a good point, may as well enjoy it, if it goes its not like its the end of the world anyway, either back to Game for a swap, or M$ for replacement, and i can still use my PC. :)

Yeah I agree with that Jkrohn1, The last thing you want is it to fail just after the years warrenty ends, but its like someone said before you only hear bad stories about the 360 and no-one starts a thread saying "my 360 works 100%".
I do believe though that this problem is a little bigger than the 3% Microsoft first disclosed but I would imagine it to be no more than 10%.

Its really just teething problems due to a rushed launch and hopefully the update thats soon to come will sort a lot of the problems out, The more worrying news for me is that apparently the makers of The Godfather have removed all information about it ever coming out on 360 which could mean its been delayed or scrapped.

Have they? Last I heard (yesterday) was that the PSP and Xbox360 versions were being delayed until the Summer and that the other versions were still on target for March

From IGN:
January 18, 2006 - With a title as important as The Godfather, Electronic Arts has to get things right, which is why the company officially delayed the game last year at its annual July Hot Summer Night event. Today, Electronic Arts has again delayed the Xbox 360 and PSP versions, while staying on schedule for an Xbox, PS2, and PC March release.

EA would not explain the full reasoning behind the delay, though it's clear that the game's size, scope, and multiple SKUs using vastly different technologies have much to do with it. The Xbox 360 and PSP versions are likely to be delayed to a late summer release, said an EA spokesperson, though he could not confirm an actual month.

The Godfather is EA's first open-design or urban mayhem-style game, based on the Mario Puzo novel and the 1970s Francis Ford Coppola movie. In it, players create their own Italian-American gangster from the time period who makes his way up the Corleone family chain of command by eliminating rivals gangs in New York and taking over their businesses.

IGN will have more shortly on The Godfather.

well i had some problems with my 360 only had it for 2 days then took it back to shop got full refund and they gave me refund from game i bought also.I am not going to buy a 360 yet i am gona wait abit becuase it seems a lot are having trouble with faults.

had mine for a few weeks now, and for the first time on tuesday night i noticed some crazy blue colours just appearing for a split second while playing PGR3. it only happened while i was playing the nurburgring tracks a couple of times. havnt seen it since even though ive been playing on them and for longer periods???

could it be borked??? (really hope not as i dont want the hassle of RMAing it)

As I said before, my 360 started showing minor glitches and just got worse, seems like the memory is breaking down in my console, I would say just keep playing it and see what happens.

By the way it now 6 days and I have not received the box yet,, well done microsoft
