Because it seems it's okay by everyone to **** underage girls who lie about their age and who may look older and get away with it.

Maybe that's a Scottish thing, but let's remember, he's the victim and not the 12 year old girl.

Irrespective it is still statutory rape. The sentence is a joke and I hope it gets reviewed.

Personally i never have sex with someone without taking copies of her Photo ID, and two proofs of address. If they fail a credit check i still need a guarantor as well.
 
I think that's a very important point. A legal system which explicitly states "it doesn't matter if you have a reasonable defence against a charge" is not a fair legal system.

I also think it's a bad idea to classify consensual sex as rape. A distinction between consent that carries legal weight and consent that doesn't carry legal weight is needed. Using an age as a crude and wildly over-simplified line is justifiable as the least bad option available. But some other word should be used because it's extremely misleading. This person, who is guilty only of being fooled by a very plausible lie, will now be marked for life as someone who used violence to overpower a 12 year old and force sex on them against their will, because that's what people will think when they find out he was judged guilty of raping a 12 year old.

Agreed good luck going to the US on holiday with that charge. :(

I doubt this is her first time of having sex.

Good to see the Judge has some sense not to ruin this blokes life any more than the media will have done now.
 
It's one of those rather odd cases where according to the letter of the law he should have been sent to prison but the Judge has used a bit common sense instead. 12 YO girl out drinking vodka 12 at night and sleeping with strangers, feel sorry for the girl she needs help.

Probably been said before but ... Where the hell are the parents? This whole thing is entirely their fault.

I know ignorance does not protect you from the law but its a tough situation.

The media has destroyed his life in many ways already. All it takes is a google of the name during a hiring process and boom - no job. I believe he also has to make it known during appropriate applications.

Oh I see. Sorry but I just jumped in to the thread without reading up on it first. Still, how old can a 12 year old look? Maybe I'm naïve but I doubt I'd be fooled by 12 year old girl trying to pass herself off as an adult.

That would be a good point if he'd known she was 12. It would be a fair point if there was any reasonable way he might have had any doubts about her age. But neither of those things are true - all the available evidence indicated that the youngest she could be was 17. Everyone else thought she was at least 18 - the door staff, the bar staff, the police on the beat who'd spoken with her earlier, the taxi driver - everyone. She told him she was 17. The judge thought it was reasonable to think she was at least 18 and that was with the judge knowing she was actually 12.

So what you're advocating is that he be jailed for not having sufficient psychic powers to magically know that all the available evidence was wrong.
