I don’t care how drunk you are, if someone is passed out you should know that having sex with them is off the cards, and if they’ve still conscious but can’t give you enthusiastic consent then it’s still a no.
There will always be grey areas, but for the benefit of the people who are actually getting raped this can only be a positive step.

I was at my house drank a ridiculous amount and I got naked and then passed out in my room. I woke up to a girl on top of me having sex with me , I honestly had no idea what was going on my head was spinning , after a while I realised i just wanted to sleep and told her to get off , after a lot of persuasion she did.
I guess I was technically raped but honestly I didn’t care. I got **** faced in my own house, got pretty naked in front of them and went mental.
If a girls gets totally wasted and gets herself in that situation I guess she could cry rape, my thoughts are that she should just toughen up and get over it

You weren't raped, you were sexually assaulted. Females cannot be charged with rape as according to the law it requires penetration.
That's what I pointed out in this thread something like 7 years ago. A man has to always make the correct judgement on a woman's state of inebriation, no matter his state of inebriation. Its daft.

We trust men to make sensible decisions even when drunk, and hold them responsible when they fail to do so.
We don't trust women to make sensible decisions when drunk and don't hold them responsible when they fail to so.
I'm not saying rape is fine, far from it, but there's a world of difference between being too drunk to say no, and being drunk enough to say yes to someone you'd normally say no to when sober (this applies equally to both men and women!!)
When it comes to the former case, then by all means throw the book at them, but when it comes to the latter, the fact it is always the man's fault says a lot about society and how we view men not only as predatory, but also mentally superior to women (pointing out here that this absolutely is not my opinion, but what this says to me)
It's absolutely crazy that a woman having had a bit too much to drink is considered unfit to consent to sex and has all responsibility in that situation taken away from her (and thrown on the man) however if that same woman in the same state of drunkenness got behind the wheel of a car and drove it would have the book thrown at her.

I can imagine some cautious folk taking paperwork for the bint to sign as consent, and going out onto the street to find two independent witnesses to the consent form signing. If things carry on as they are women will be sexually frustrated and all but unemployable, as will people of colour. One can take cries of rape and racism to the degree when they backfire spectacularly. Personally I think capitualating to giving them the vote was madness
