Alcohol and ability to consent

What if a man and a wife have a good drink. Eg a couple bottles of wine after dinner.

The courts assume implied consent* within marriage unless consent is explicitly withdrawn, so in your scenario the bloke would be fine.

As is poking your wife whilst she's asleep <ahem> ;)


*The official line is this no longer applies in the UK but it's still taken into consideration in the (very) few spousal rape cases that reach the courts. Nearly all cases I'm aware of where the husband is convicted of spousal rape, there is a history of domestic abuse or explicit non-consent. Poking your wife in the middle of the night or having a drunken fumble will be NOT get anywhere near a court.

Quite - it's not like there aren't enough sober women out there willing to do the deed!

See the problem is most sober women wouldn't even consider most of these guys LOL LOL

most of these guys know that the only chance they have is when a women is intoxicated LOL LOL
 
Its never ok. its just at bad..what is also bad women making false rape allegations

But the law isn't being changed in a neutral way. It's being changed to specifically favour women.

I'm sure if it was to do the opposite it's known as sexism but hey ho.
 
If it makes guys think a bit harder about the possible repercussions before a sexual encounter then it is a good thing. The worst result is that two people who want to have consensual sex don't, which is hardly the end of the world.
 
Back in my twenties some twenty years ago I had a few drunken fumbles after a night out. On most occasions they wanted to take it further but I came to my senses and backed out.

Looking back I regret getting into that state and feel some guilt about it. These were girls I wasn’t particularly attracted to I was just intoxicated.

I bet this happens quite a lot.

Run me through that logic?

Are you using the lazy trope that all guys get brewers droop and, if he can perform, he's not as drunk as the woman therefore... What?
 
I was extremely drunk believe me, but was still able to get it up. Normally I’m quite a social phobic but after 10 pints I lost all my inhibitions and engaged in this risky behavior. I’m quite a dork normally so this was way out of character.
 
Anyone saying this is a bad idea is mental :cry:

I don’t care how drunk you are, if someone is passed out you should know that having sex with them is off the cards, and if they’ve still conscious but can’t give you enthusiastic consent then it’s still a no.

There will always be grey areas, but for the benefit of the people who are actually getting raped this can only be a positive step.
