AMD Bulldozer Finally!

that maybe but most reviews state it does not perform as good as the phenom II , but from what i have read this is not the case . i will admit it does not perform like AMD said it does :( , what does it perform like in games (not benchmarks)

i've already shown BD 8x performs the same as a phenom II 6x in encoding clock for clock

yes we know phenom II 6x can clock to 4-4.2ghz and the BD 8x can clock to 4.5ghz+ which would make it slightly faster in encoding over phenom II 6x but in everything else such as gaming ect BD 8x at 4.5ghz = a phenom II 6x at 4ghz...

You showed it takes the same clock and 2 more cores.
 
I know this isn't the place, nowhere is really but I know there was a lot of talk about DSR here, maybe you can help. I hope you can.


I ordered a new X58 setup from the OcUK clearance section, cpu, mobo and ram.

The cpu arrived with TIM on it and the mobo had no I/O shield (that was sortof expected)

I contacted OcUK to arrange a return under DSR but they've told me that because the items were sent to my business address (which is the only place I can take delivery during the week) that I'm not eligible for DSR.

Is there some way I can return this stuff? I've ordered an sandy setup (new this time) which will be arriving soon and I can't endup with 2 setups.

Can I return it all because the chip was mis-sold? There's thermal grease on it.

I'm freaking out, this bill is going to be insane.

What can I do?

If they are taking that stance then it may be difficult to get them to budge without outside help, best I can suggest is don't use your work address and give them that excuse in the future.

Try contacting CAB and see what they say.

Being sent to work should make no difference as they have a right to send back goods as well, if not arrived in expected conditions, unused in this case.
If the goods come as expected condition unused, then you have no claim to sending it back from a business unlike when its delivered to your home, even if there is nothing wrong in any way you can send it back from home.

The only thing if you bought it B Grade.

If something is being sold as new unused, it does not make any difference if it work or home, it can be sent back.

I was just going by DSR saying that business to business transactions are exempt, but if you bought it with a personal credit card you should have enough evidence that it was a private sale but it's all about twisting OCUK's arm.

Yes business to business transactions are exempt, but it does not say business to business are exempt from expecting or have a right to unused goods.
 
Rather than getting angry and contacting CAB. Try emaling OCUK and see what they say. Use your powers of persuasion. You will be surprised what can be achieved with the power of words.

Ass mmj suggested, state that the items were bought from a personal/private credit card. And make it clear that this is not a business purchase.

If that doesn't work try calling them again and see if you can get somewhere. Don't bother making threats as that will not help you at all. It will make the matter worse (for you).

EDIT: You used a business card. Like you said...you are snookered. NO DSR on business purchases.

This is true. You will be entitled to a "new" replacement if nothing else. I wouldn't want a second hand pair of underpants and Bulldozers are also generally regarded as pants:).

edit: and if they cannot replace the part within a sufficient time period (for example if they are out of stock) you are entitled to a refund.

My understanding (and I could be wrong), is that no consumer has the absolute right to return an item. Once the item is purchased, the retailer does not have to take back the item.

Obviously, larger companies allow returns.

The above does not apply to DSR and also in cases where items were broken/faulty/not as advertised.
 
I've contacted the management and tried to explain my side of things. I'll hopefully get this sorted and be able to get on with my build.

I'll not be making this mistake again.

Do any items on your invoice state B-grade? if the CPU and motherboard do then you've no real right to complain about them not being in pristine condition, if you want new you buy new. :)

I would still push for the DSR though, in all likelihood they're probably just hoping you'll go away quietly.

Whilst on the subject of DSR is it normal when requesting a DSR return to get an RMA number ?

I just did, the wording is exactly the same as a standard RMA with all the wriggly get out clauses and excuses to charge you etc.

I didn't expect that with a DSR return.

If the items were paid for on a business card and it was invoiced to a business name and address then yes, you are not entitled to DSR. (I've been caught out with this one.)

If, alternatively, you invoiced it to a personal card and address, but requested it to be delivered your work merely for convienience then you will be legally entitled to DSR and OCUK should not be shirking their legal responsibilities.

MOst companies hate DSR, it creates a real mess as stuff has to be sold as second hand so they will do anything to avoid it. Don't give them any excuse.
