Apple vs Samsung, court orders Samsung to show Apple 5 new phones

Its about time apple manned up and starting competing fairly instead of all this crap, how insecure are they about their products?!?!

To be fair, it's an extremely competitive market. The problem is that Google and Apple will end up just copying each other no end and we'll end up with very similar devices - which will nullify competition.

It's understandable that Apple are bound to feel a bit aggrieved about things having effectively started the smartphone and tablet frenzy and then see Samsung copying their things, which is undoubtedly one of the reasons they've gone after them pretty hard.

I'm not really sure how it can be solved to be honest.

Is it possible to use an ipad 3g for calls or is it data only? Or is there a hack. As there are rumors of a 7inch ipad and I might get one if the calls are possible.

On topic, they just need to license each other's ip but how do you make a tablet that doesnt look like a screen attached to a squarish device?
 
apple feeling aggrieved might be ok if they didn't then go and do something similar. trouble is it's not like they don't steal ideas so all this just comes across as selfish, money grabbing and like a little child moaning one company steals their stuff whilst they go and do it themselves.

any way best not say too much else i'll be called an andoird/nokia/win phone fan boy again
 
It's not band, it's also a frand patent. Apple have agreed to pay going forward, they are now just arguing over what is owed for the last 4years and becuase it wasnt paid, it doesn't have to be at the frand level.

It's also only in a regional court with patent "experts" expecting this case to last years, once it travel up to the more important courts.

Apple had offered to pay a Frand-set fee going forward and was willing to pay a similar rate for past infringements. But it lost the case because it tried to retain the right to contest the validity of the patent with a view to past damages.

It tried to do this because Motorola had defended its right to charge an above-Frand rate for Apple's use of its technology over the past four years. This could have been many times higher than the rate Apple was willing to pay and potentially very expensive.

Motorola will have to post a 100m euro (£85m; $133m) bond if it wishes to enforce a sales injunction against Apple. The cash would cover compensation to Apple if the ruling was later overturned.

You can use it for FaceTime/Skype/etc calls but as an actual phone with a phone SIM card - no.

Are there rumours of a 7 inch iPad? I'm still not sure you'd want to use one for calls, at least not without a bluetooth headset.

Apple ordered to stop selling iPhone/3G iPad 2 by German court

While Apple and Samsung may be doing a lot of fighting as of late when it comes to patents, Motorola is also stepping up its fight against Apple. A court in Germany has ordered Apple to stop selling the iPhone and 3G iPad 2 according to sueddeutsche.de (translated).

The news is surely a blow to Apple as Motorola has put a stop to the sale of two of its hottest products. While the translation offers a lot to be desired in terms of clarity, it appears that the ban is related to a Motorola patent based around data transmission via GPRS.

How long the ban will be in place is unknown and most likely will depend on how quickly Apple can either license the patent from Motorola or work around the part that is infringing on Motorola's patent.

It was not long ago that Google made a move to acquire Motorola to help protect it's Android products from patent disputes. Seeing that Motorola was able to win an injunction in Germany means that they could potentially move to other countries with the same claim.

Apple has stated that they plan to fight this ruling.

That's not what other news sites are saying.
It's saying now Motorola have won the case, they can if they wish stump up €100mill and go back to court to try and ban apple devices in Germany. This ruling was from a regional court, not a big one.

So which is it?

It's also frand patent, so once apple settle the outstanding bill, they can't ban apple devices. They have to allow apple to use the patent as long as they pay. Which again they've agreed to, going forward. They are just arguing over what needs to be paid for the last 4years.
 
Ah, so it's a non-story then.

It seems so, the articles saying its frand patent and that Motorola would have to stump up money to ban apple. Is what I would go with at the moment, seeing as they include such details.
If it was banned why would the BBC say its not. When Samsung was banned in German courts BBC reported correctly.

Who started all this patent craziness? They all seem to have a hard on for taking each other to court these days.

The most recent spate of the last 5 years was Nokia suing Apple over a FRAND patent but honestly, for years Nokia and Motorola have been having big ol' fights because they own a big amount of wireless data patents, absolutely tons compared to others really. FRAND and the 3G patent group basically exist as they do today to avoid the scenarios we are seeing from happening around 2002 when 3G was getting launched properly.

I can't wait until LTE comes out too and we can enjoy this crap again. And considering the bands being selected for LTE we can also look forward to crap roaming too, awesome :/

Edit: Motive is always money, patent enforcement is easy cash for effort involved.

You forget to mention the billion patent disputes between x phone manufacturer and Kodak which have been going on since 2002, pretty much.
 
Indeed, imaging patents must be the sole reason kodak exist today in the way they do considering where their market went. Wikipedia's take on it - "As part of its turnaround strategy, Kodak has turned to aggressive patent litigation in order to generate revenue". Moto and Kodak have a huge cross license for what it's worth, bullies know what's best for other bullies would be my take on that.

The new patent troll company Apple made to sue other companies just makes this side of the business darker too.
