Apple vs Samsung, court orders Samsung to show Apple 5 new phones

What's more interesting is despite a drop in sales, apple was the only one that grew.

Blackberry is abut to go extinct. We all know windows is releasing new Os and phones. But I haven't heard anything from blackberry recently. What are they doing?

BB OS10 launching soon and they are looking to license it to other manufacturers.

I suspect that's the new ipad making an impact more than the iphone as people will be waiting on the new iphone to upgrade or buy one.

I'm not sure tablets are included?

Either way, the assumption people on mass are getting fed up of apple and aren't buying apple products is just not true.

Yes it is included. Any device running iOS is included in the stats as would any tablets running Android.

It's not true for the USA but not looking to be so for the rest of the world.

Wait, have I read this right. There were 700 patent question that they have had to decide on and they took only 2 days to come up with a verdict for them all?!

There wasn't that many patents.
Just lots of phones and then then several questions on each phone.
Did it break the patents yes/no did it willingfully break patent yes/no.

So it's actually not that many at all. Also once they've accepted the patent. It's pretty easy to see if a phone includes that patent.

Few inconsistencies - Jury awarded damages for the galaxy tab but said it didn't infringe.
Considering the total is so small (million something over 2 devices... ) it's Likely an honest mistake rather then Bias - i mean, why bother sneaking an extra million in on damages worth a billion+? To screw Samsung ? Then why not just say the device infringes and likely increase the damages by another billion or so

Good point.

Apple's point was that it was possible to create an experience that doesn't look like its designs and only Nokia and RIM Blackberry are really doing that right now."

Nokias smartphones do look very unique. Not sure I agree with only though. But they are the most distinctive ones. Not that I think it's an issue with the newer devices, just the older ones.

Do people agree/disagree?

Michael Gartenburg, research director at Gartner, said the verdict could have major ramifications for the wider smart device sector.

"Apple patents being upheld will force the rest of the industry to both innovation and differentiation," he told the BBC.

"That will be a good thing for consumers in the long run. Anyone who was even thinking about borrowing a technology or design from Apple will think twice about it now.

Looks wise I think it's right, but things like bounce back and pinch to zoom, is just the best way to do and other companies will have to license it.

Apple is a US company - so they will get favourable treatment over a foreign company.

OTH,the Apple lawyers were using "nationalist" and "economic" sentiment though:

“If you find for Apple in this case, you will have re-affirmed the American patent system,” said Mr. McElhinny. “People in this valley will continue to invest because they know their investment will be protected.”

So basically, they are saying that if the jury did not vote for them, they are knocking down an American institution(in favour of a Korean company) and moreover, people will not invest as much in Silicon Valley as investments are more risky, which is a veiled hint at job creation. Remember there is a recession going on,and this is as touchy in the US as in any other country.

Remember what happened ,with the recent purchase of Brazilian light attack aircraft ?? After much whinging in the US that foreign companies won(even though they had US partners and most of the aircraft were to be built in the US IIRC),they overturned the decision. It has been the same with many large procurements, where US companies have pushed the economic benefits over foreign bids(even though they are probably creating a similar number of jobs in the US too).

I would love for Samsung to stick two fingers up at them and stop selling any parts to Apple for any of they products they want to make and withdraw the 4billion dollar investment they just made for future plants. Drop the S3 price everywhere to take a massive foothold in europe and the rest of the world and leave Apple stuck in the USA where it bloomin belongs. This was clearly America vs Korea nothing more leave Apple up the creek without a paddle but meh we can only dream.

Hopefully a few more isheep will see the light with Apples recent sue everyone because we can attitude.

I hope Korea does not buy more F15k fighters for its FX phase 2 and phase 3.

This is worth nearly $7 billion, and if they decided to go with something else, that would be a strong enough message IMHO.

Money talks though in the US,and Apple did use economic arguments during the trial(basically support American companies),but if it means something like Eurofighter gets selected I would be fine with that. BTW,the F15,F35 and the Typhoon are the three contendors for at least 60 fighters.

Samsung is a major employer in Korea - and they do more than build phones,ie, weapons, ships and aerospace products.

Good idea, alienate your biggest customer (board will love that) and break a contract likely to cost billions more in damages .. And for what? Apple have assurances that other companies such as TSMC could run the process no problem.

Hence why its never going to happen but it would have been awesome to see it happen. however can they now if they wanted to increase prices of parts they sell to Apple?

Have we had any posts about Korea waging war on the USA yet?

Heh, silly question. :p

Droid rage is engulfing the internet!

Tim Cook's statement to Apple employees:

Today was an important day for Apple and for innovators everywhere.

Many of you have been closely following the trial against Samsung in San Jose for the past few weeks. We chose legal action very reluctantly and only after repeatedly asking Samsung to stop copying our work. For us this lawsuit has always been about something much more important than patents or money. It’s about values. We value originality and innovation and pour our lives into making the best products on earth. And we do this to delight our customers, not for competitors to flagrantly copy.

We owe a debt of gratitude to the jury who invested their time in listening to our story. We were thrilled to finally have the opportunity to tell it. The mountain of evidence presented during the trial showed that Samsung’s copying went far deeper than we knew.

The jury has now spoken. We applaud them for finding Samsung’s behavior willful and for sending a loud and clear message that stealing isn’t right.

I am very proud of the work that each of you do.

Today, values have won and I hope the whole world listens.

Tim

That will fuel the fire! ;)

I doubt Samsung care that much to be honest, and I'm sure the appeal will end up knocking the cost down even more. even if a sales ban take place on set products its all old stock so who gives a ****? They just end up releasing a newer version if so...
