Consequences of crash?

Clearly don't know the full facts here - sounds like OP doesn't either.

The wreckage of that Ibiza looks serious though and it's lucky that both parties came out unscathed. On another day this kind of head on accident could have been fatal, so whilst no one has been killed/hurt etc. I doubt the driver will get off lightly.
 
No chance he will be going to jail for that if everyone walked away - unless he has a very long list of previous.

Can almost guarantee they will try to prosecute for dangerous driving which may or may not be reduced to careless. Difficult to sympathise by the sounds of what happened, but I guess everyone makes mistakes....not everyone gets a second chance at that kind of manoeuvre though, very very lucky boy.
 
Like someone said above I don't know what happened apart from he hit someone head on shortly after attempting an overtake.

It's obvious though he was driving like a helmet. It could have been soo much worse, it's a miracle the other occupants in the other car walked away.

It's actually really peed me off and I just hope it has scared the life out of him.

100% this. Even though we all know dangerous driving would probably fit the crime nicely, it's hard to prove. Although who knows, if they've got a bunch of witnesses saying how terrible his driving was pre-crash, i think a dangerous would probably stick. If he does get done for dangerous driving, he will lose his licence for a minimum of 12months - and rightly so.

Its hard to say, but to get in a head on collision in a 40 zone from overtaking it sounds like he must have been driving like a complete *******

Should get done wreckless driving, the fact that he and the others walked away is LUCK. From the look of the damage to the cars its a surprise there were no injuries
 
The whole sequence of events sounds so mad, is there a chance he may have been drunk?

40 mph limit. Rural or residential? Google maps google maps!
 
No definitely not drunk, it was in the morning.

More like a mix of bad driver, fairly powerful car (it was cupra) and a fair old chunk of stupidity.
 
I am by no means encouraging this but the amount of high horses with out proper knowledge around the accident. He may of been an idiot and driving very stupidly but equally, I bet there are a few others here that have over taken farm machinery on the roads in a 40 zone, myself included. The sad problem is he was unable to do what ever he did safely and has no doubt caused a lot of issues for the person he hit and himself.

Although driving a ibiza does justify that the driver must be an idiot...

Of course there are situations where overtaking in a 40 is perfectly acceptable. But there's only one circumstance that I can conceive where it wouldn't be the fault of the person overtaking - that is if someone pulled out of a side road on the right.

If he didnt have a clear view and a long enough stretch then he was an idiot for attempting it - it's fairly obvious that he failed on at least one of these things
 
If you have a head on whilst overtaking you are definitely driving like a ****. I really hope he gets prosecuted. It looks like he had a fairly glancing collision on the right side. A full head on could have been much worse.
 
Driving without due care & attention or possibly dangerous driving. The two offences can have quite different punishments even though they sound similar.

Not so IMO. One of the things you need to check for before an overtake is side roads . If there are any don't go!
