None of that makes any sense at all.
Accounts are not banned for credit cards going out of date.
I would ring them again, if you get no joy then write to the gaming magazines like OXM and get them to fight it for you.

Ive been away for 2 months and as such havent really had much time on the internet or a phone.

I got home yesterday and turn on my xbox to find my account suspended. I phone up to see whats going on, and am told that my account is banned and as such unusable, they will not (or cannot according to the guy on the phone) reactivate it. Seeing as my xbox died earlier this year due to the inherent design fault I no longer have the original console or the gamertag that over £50 worth of DLC is linked to.

The reason my account is banned is because I did not pay for the gold membership as my card details were out of date, and so they were trying to charge a non existant card I didnt have access to the xbox and so could not update the details. I got an email to say my gold membership had been cancelled but nothing of an account suspension or ban.

Just spent 40 mins on the phone with a guy who basically told me that microsoft dont care about me as a customer...which was nice.

You say your original console died, i presume microsoft gave you a replacement? There was talk of people getting consoles that had been modified back and were innocently banned when all the modders got canned.

The DLC you have will still be there when you get another 360, i got my 2nd 360, and didnt have to pay for my games i had already purchased, just redownloaded them again.

I agree, replacement console which was a refurb & previously modded sounds more plausible.

If so, its unlucky and you should really get some sort of action from MS.

Well apparently Ive had an active gold subscription for the last 2 months that as such has not been paid for and so I have violated the Billing T&Cs which according to the guy on the other end of the phone is a "very rude violation"
Again that makes no sense. If they did not terminate your gold access when the paid for service expired then it is their fault not yours. There has to be more to this than a simple payment issue.

If it's their fault are they going to put their hands up and admit as much? I dont think so...

Sounds harsh then, keep trying them and keep explaining what's happened.

Never personally heard of anyone being banned for not being able to pay a sub, it should have just reverted to Silver surely?

Yes they should do. They've made a mistake and they should rectify it.
Once your subscription expires they stop providing the service, banning he account seems extreme and wrong.

Well when I cancelled my card, MS tried to charge it for the gold sub, but only left a message saying they couldn't do that, and that I had to input my new card in if I wanted to keep the subscription. I didn't get banned, nor were there any threats.

Ok progress on the phone, they are essentially holding my account to ransom...the guy on the phone says I pay the money and I get my account back, I don't pay the money...no account for me. What the hell??

That makes far more sense tbh, and is what I would expect.

why would you expect it? He didn't renew his subscription but they kept it live for two months and then expect him to pay for it even though he didn't use or ask for it!!! Then they hold your account with games purchased to ransom until you pay up - sounds like they are being right ****'s to me!
