Do I need a Structural Engineer ?

how should i handle this please ?

Tell him very simply:

1) You will not agree to a structural engineers cost or assessment.

2) The the builder has a right to correct the issue first. If he is refusing to let the builder fix the issue then he would lose any small claim made against the builder.

3) He needs to deal with the builder, as thats why the builder will have indemnity insurance and the one who is liable.

You contracted someone to do the work, the builder has messed up and so you should put the 2 on contact with each other.

Not your problem and not your cost to fix or pay for a structural engineer.

But it doesn't really matter what we say as you keep ignoring any advice given.

A structural engineer will tell you to never screw nails in, absolute disaster waiting to happen, could have brought the whole house down.

You didn't "screw the nails in", your builder did, so your neighbour needs to ask the builder to make it right. Builder should have the opportunity to correct the mistake. If the neighbour wont let him try to fix the issue, let your neighbour sue the builder or take it to small claims court - all you have to do is make sure your neighbour has the builders contact details.
 
Given it looks like the boundary line did you get permission to fix anything to their property? I know it seems like he's being an arse but it's technically criminal damage.
 
What is the problem, have the screws gone through the other side and are now poking out or have the screws been removed leaving some small holes?

Needing a structural engineer is just nonsense, ask the guy who put the gate in to repair the damage. I bet he'll just put some filler in and use slightly shorter screws.

If my neighbour made some holes in my garage wall I'd be annoyed as well but more at the inept muppet who did the work. I'd be annoyed if the neighbour didn't ask before doing the work although not sure on the legal requirement there.

The legal position is you need permission to do it. If permission can't be obtained you need to put a post into the ground to support the fence panel like they have for the gate latch. I'd be pretty upset if my neighbour did that without asking, especially if they have drilled right through and blown the face of the brick off in the garage. Let's face it, it's not a nail, it's likely a nylon sleeved frame anchor and I bet it's gone right through.

Criminal damage is any damage which has been caused by an individual to some form of property. A civil matter is the dispute this may cause, but the damage is different.

That said if you have permission to do, what's the problem?
