DON'T BUY MSI THEY MIS-SOLD TOP SPEC GT SERIES LAPTOPS with MXM Graphics

tropicola, can you briefly tell us what happened with your repair invoice and how you got them to drop it ?

MSI want me to pay £150 repair bill for a couple of small dents, they say its not covered in warranty. It really wasn't my fault, those dents where there last time I got an RMA, though didn't mention it to MSI at the time, Doh.

different though if it's an opinion or speculation though? no one has flat our said "MSI are 100% definitely doing xyz?"

even MSI email states;

Suggesting we are leaning on Overclockers is damaging to our brand and reputation and we will seek immediate redress.

key word "suggesting" surely, that isn't making a claim just an idea and opinion which we are all entitled too.

either way looks bad and I doubt MSI will seriously consider suing one of its own customers who is clearly annoyed at the lack of customer service and resolution to what should be a pretty big deal.....

Problem is there becomes a time when its basically down to a court to decide if its honest opinion or not.

MSI HAS ATTEMPTED TO INFLUENCE OVERCLOCKERS IN REGARDS TO THIS THREAD.

I couldn't be more succinct than that.

I have this from multiple sources.

I look forwards to notice from MSI's legal team.

OK, this intrigues me. Why would you say purchasing another notebook means I have walked away from due recourse?

I'll try.

To honour the upgrade would be a far cheaper alternative than replacing whole units - even with people paying the difference - this is likely because an upgrade is considered not physically possible or potentially dangerous/damaging heatwise - i can only hypothesise here. But honouring the upgrade would be cheaper for them.

They have in turn offered something that they deem as a suitable alternative - whether or not the value here is suitable to both parties is what i admit is in question, but it could be argued that it is reasonable.

I think you would have real trouble trying to get anywhere with trading standards etc over this. Advertising standards maybe - they probably ought to have printed a public apology letter clarifying the what's/why's etc to mitigate this.

Anyway, I digress, by walking away from the alternative offer (upgrade or nothing) - assuming that you have sold on your MSI laptop to buy the aorus, you have actually put yourself in a weak position legally as you have voluntarily walked away from the alternative offer(again assuming the former) - i.e. accepting the "nothing". Your recourse, if you felt the offer was not good enough value would have been to stay in the process of remediation.

You no longer have any form of remuneration due to you - you now lack strong grounds to proceed with your complaint and as such you leave yourself increasingly exposed to libel.

Not saying you don't have a case at all, but its getting weaker all the time.

big cahoonies my friend lol just be careful as that's no longer an opinion.

well I made Neil aware of the laptop key being broken he said it would be covered under warranty. however they said the keyboard membrane was damaged and water under it which simple wasn't true.

I got rid of it partly because neil agreed in the first place but also because this should be an upgrade, condition of the laptop or if it was within warranty shouldn't enter the equation here... as they are FORCING you to swap to a new laptop at a more expensive price as they can't offer an upgrade (despite people successfully installing one with a heatsink and tweaking a few driver settings in Poland, where their service centre ok it might not have the same benchmark but it proves it's possible and im sure MSI could have done this better with their experience....).

so I simply refused to accept it and said the deal is off if they charge me for a repair, we agreed a price for a straight upgrade no repairs....

I would reject it mate, especially if the damage was caused through previous RMA however as you didn't raise at the time they will have to take your word for it (just like we are taking MSI's word for it how a 10x upgrade isn't possible).

and MISJAH still has his MSI as far as I am aware (or did you ship it?) he bought an auros as for example I'm three weeks without a laptop almost.... they have my money and my laptop... I have no laptop.... plus if I had the cash I would have bought a new machine, got the MSI upgrade then sold the MSI.

But as money doesn't grow on trees I'm stuck with the MSI and the upgrade (which im sure will be nice, but looking at MSI logo and all the stress and annoyance they have caused me daily is going to be a reminder daily about my experience lol)

"Problem is there becomes a time when its basically down to a court to decide if its honest opinion or not."

meh, for all we know people making these comments could be mental, intoxicated or other reasons. Stress for example over the issue might cause someone to say something they regret. Anger could also do the same as above....

oh and neo, back to your "fair deal" I see you lost a limited edition version and some features, did they advertise you would lose features when upgrading to a 10 series at the time of purchase? You may have a nicer price than others, but you've probably lost more in terms of the laptop features perhaps?

Thank you for endeavouring to explain your comment it is appreciated.

Your assumption is incorrect, I have not sold my GT72 and I am involved in the trade-in process.

I believe be held accountable to what you publish online is a major factor in this ongoing saga.

I stand by my statements, when will MSI stand by theirs?

In all seriousness MiSJAH you probably should at least have a chat with a lawyer - its better to be safe than sorry. They most likely wont sue - but i couldn't say for sure if your comments could be libellous - I'm sure i heard somewhere that people have been sued over social media comments recently.

Or chat with Citizens Advice or something.

Apologies for the double post, I don't wish my posts to appear 'edited'.

'exposed to libel'?

My sources are strong, I have no fear.

Given the amount you are spamming "Without prejudice" I hope you aren't going to be that guy that ends up in court relying on a "common law" defence and gets utterly bent over. Working in retail it wouldn't be the first time I've seen it.

To be fair I am confident to make the posts I have without the "Without prejudice" but I am erring on the side of caution.

No nothing, on my box it clearly said, MXM can be upgraded two generations.
Nothing was mentioned about losing features, I do have my original query here :

https://forum-en.msi.com/index.php?topic=274859.msg1565263#msg1565263

All I got in Nov/Dec 2016 was a list of new laptops, none of them where the Dragon special edition. I did some research and all I lose is some memory and SSD space, with the bluray burner, which I never used.

I do love the special edition though, the casing was really nice, now its back to the original looking models, which is a bit **** to be fair. I guess if anything I`m loosing the cool factor special edition look. I would pay extra to keep it if I could, but cant see them bringing one out so soon :(

Just to add, so I take it 3 working days for funds to clear and then 7 for them to ship out the laptops, would this be correct ?

If so, I have a very long wait.

@Neo2016

I would suggest emailing MSI about that, if you have Natalie's email she has been very helpful previously.

I'm glad you mentioned the 2 upgrades, MSI UK Notebook bury their heads in the sand when it is mentioned. Do you happen to have a picture of box where it is stated?

Cheers.

Sadly no, its all been shipped out, no doubt MSI will destroy the box and repackage it.
Wish I did take a pic now, anyway another day over and nothing, I`m getting a bit impatient now.

Why have OcUK deleted their comments from the other day?

Surely if they and MSI never decided to remove the post, they would've stayed. Not even deleted with username still there, completely gone.

Cus OcUK might not wana lose customers due to msis balls up?

And neo

They said to be

Up to 7 day to rec and check laptop
3 to 5 for payment
7 days for shipment of new one

Buut ive gone more than this...

Got an email now stating my laptop shipped before wed this week....

And that person dealing with this was on holiday fo4 Chinese new year.... They have 1 person?! Hrm....

That sucks, so its looking like another 2 weeks then at least ?
If I could take time off, I would fly to Amsterdam and pick it up my self and give them cash.
That would work a smoke and my computer, what more could I ask for.
