Driving when wasted?

But if you were pulled over because a bulb was out and then are tested and found having a substance in your system it should not be prosecuted - who cares what you had in your system, as long as your standard of driving was acceptable then it doesn't matter.

I would guess its as a precaution, you might well be feeling fine at that moment, but who is to say that the effects might not become apparent 20 mins later and the reaction delay or decision impairment then causes you to kill someone?

I mean I know I would be more than a little miffed if halfway through a flight I was informed that the pilot was drunk but its ok cause he's feeling fine :)
 
Well drunk driving was very limited to what the police could charge you for years back so it got changed to driving under the influence. This is much broader and can include anything such as drugs, drink, medication, etc.

No.

"Under the influence" means that it's influencing your driving and thus I think being prosecuted is fair enough - you should not be behind the wheel.

If you re-read my posts you'll see that I said "shouldn't matter if it's not affecting your driving".

I think the same, but i dont think police would see it like that. Like if someone crashed into you and you were found to be drunk. It would still be your fault i think

Everyone keeps on saying 'under the influence' but under the influence of what?

Can you be 'under the influence' of anything that changes you?

why are you even justifying it?

Isnt that part of the problem though? It might well not appear to be affecting your driving until the moment when it does and someone dies? What would we be saying for instance if a driver who was drunk but seemingly driving ok, was pulled over by a cop, the cop showed that the guy was drunk but decided that his driving was ok so let him drive on...only for the guy to then run over some kid and kill them 20 mins later. Wonder what we would be saying about that cop and what he should have/shouldnt have done?

That was made Illegal on boxing day anyway so he would still be prosecuted ...

Good point, not sure where I stand on that to be honest.

What I was thinking of really was:
  • Person A: 81mg in the blood but it's not affecting them at all, and they're driving perfectly well, reacting very quickly to everything around them, correctly judging speeds and distances etc.
  • Person B: 79mg in the blood and they're driving really badly, slow reaction times, miss-judging speeds, miss-judging distances etc.
  • Person C: 00mg in the blood but is a dozy cow anyway and is driving really badly, slow reaction times, miss-judging speeds, miss-judging distances etc.

Under the UK law only person A would be prosecuted, but surely persons B & C are driving far worse? But as they haven't gone over a magic number they're not prosecuted :confused:.

I will certainly agree that there are a lot of people "legally" on the roads who frankly shouldnt be. If I had my way I would have mandatory regular re-sits of the driving test every x number of years for all drivers.

Its been proven that its got nothing to do with plant fertilizer and is only linked to it so it can be sold.

Dj_Jestar - Wasnt me that was driving, as i said i havent driven for years. Just trying to work out how in the crap someone would be who can drive as normal but is still a bit 'awake' and someone could clearly tell that

Infam0us - Boxing day made illegal, thats news to me. Whats it been classified? Last thing i heard was that it was being made illegal in March

Anyway, back on topic of driving, before it gets pulled...

No, if they are driving that bad they will get done for driving without due care and attention.
