employer not paying me

I don't get this. You did sign an employment contract didn't you? In that case he is surely in breach of contract? If you didn't sign a contract then why the hell are you working? No contract = No work, imho.

A contract of employment isn't required as long as there is mutuality of obligation.

It sounds like you're not an employee (not all workers are employees) so the best way to claim would be via small claims court.
 
Sounded like he made an offer which you accepted making it appear as a contract (which he breached).. Proving that could be another thing.

I knew someone in a similar position. They filed an online small claims with no hassle over the internt. Their business got a nice letter from the courts and the guy paid up pronto, absolutly bricked themselves.

Good luck then, because it didn't work for me. The court bailiffs are inept and easily diverted around here...I'm still not getting anything from them over a year later.
 
One option open to you is to take goods from his shop, assuming he does not pay up. While this might help him to give you what you are owed, it would also be illegal. The legal methods have already been explained to you, but from past experience you'll get nowhere with this kind of character if you stick to the book.

I would give him every opportunity to pay up, then "cease" a laptop or some other high value item from his shop. If you do go down this line, keep everything strictly between yourself and your boss. In the event that the police get invoved you can claim you had taken the laptop home to run some diagnostics on it, as requested by your boss.

A nice threat of running a smear campaign about serious cases of food poisoning at his take-away might also help. I know my recommendations are dishonest, but these kind of scumbags know how to play the system, so you need to play them at their own game.

i work repairing computer/laptops and as a driver for his takeaway business, and he was meant to insure me on his car, but made me do deliveries uninsured.....

can i get something out of that, or would that take my licence away?
 
it's a business registered vehicle i assume? Liability will be on the owner to insure you on it most likely. However if you know that you are uninsured and drive it then you could be held liable too I believe.

Don't get back in it uninsured, asking for trouble!!

Don't quote me on that but studied something similar in a law module

Sounds like the sort of job you'd be employed in, rather than self employed, so it's his responsibility to operate PAYE and all the rest of it, which it sounds like he isn't. If he's not got your NI number he won't be deducting NI, which suggests he's not doing the tax either, which is bad news.

Quit.

Optionally, report him to HMRC.
 
And report him to his insurance company for using his vechile for commerical use and not insuring the designated driver.

You can put this guy into a world of pain in so many ways, alas it probably won't get you your cash. Would still be very satisfying :)
 
My mate had this problem with woolworths a couple of years back, after several months and getting not even a 10th of what he was owed paid to him he just went in and wheeled out a large tv and some consoles, cd's etc. to the value of what he was owed. The security guard let him do it after he explained the situation.
 
Are you full time? (I'm guessing not)
Do you have a fixed rota?
Do you do a fixed number of hours a week?

If the answers to the above are no then I think you're a self employed independent contractor. The best method is small claims court or send someone round who you know has a big mouth and will stay there shouting at him until he pays you. Make sure you go with them of course :p

Report him to the police anonymously - iirc they take it very seriously when a business tells it's drivers (or even accidentally allows them) to drive a vehicle for the business uninsured.
It's also one of the few times the driver might get away with being uninsured, if they had a reasonable belief that they were insured to drive a vehicle at the behest of their employer (if you knew you weren't insured though it's a different matter).
He might even not have the vehicle insured fully for business use (if you're using it to deliver/collect stuff for the business i believe it needs full business cover, rather than the normal "domestic, commuting, and leisure" or whatever the wording is on normal private use policies).

By the sounds of it he's a real chancer who doesn't care for the law, so I wouldn't hesitate to call the police (telling employees to drive uninsured), the tax man (much scarier than the police) if there is any chance he's dodging taxes (sounds likely), and anyone else who might be interested in what he's doing (are his computers using legitimate, fully licensed software?).

if you want to know the best people to report him to for any criminal/driving related stuff www.5ive-o.com should be able to help as they have serving (traffic and normal) police/magistrates and insurance guys who really know their stuff ;)

i knew i wasnt insured....:D

btu he has made others do it, not sure if they knew.

and he used the same vista license on a couple computers.

will i lose my brand new (6 month old) driving license if i tell the police?
