It just seem stupid they are using comparables of a 360 on double/20k miles more they are saying its a £400 adjustment for mileage but when I say I have seen one on 10k miles less they are not taking that as a £400 adjustment in my favour :(

Seriously - I think at this point you need to point out the stress and worry this is causing you. Point out that you've had to spend an unreasonable amount of time researching this, and their offers are quite frankly insulting.

Inform them that they have 24 hours to rethink their position, and to supply you with proof of a car you can purchase before taking this to the ombudsman.

The other thing you could do, thinking about it is to phone up some dealers and ask them what the book price would be for selling them your car?
I.e. phone a dealer up, say I'm thinking of trading in my FQ-360 with this paint work and mileage e.t.c. Don't mention mods. See what price they mention. They may be reluctant to give a price over the phone, but just say you want a ballpark figure you won't hold them to before making a journey.
Obviously the price they mention to you will be low, since they will need to be able to resell the vehicle on, but i'm betting the price will be higher than the 18k you're being offered, plus you can then add the 5k mods ontop.

:( owt to save them money, despite reaming us for cash!

I can unfortunatley see this going on for a while, they'd normally have increased a decent chunk by now but still seem to be low balling.

So all of the acceptable, comparable results are what 22k+?

Considering the above, the extra effort your having to put in and the stress of the whole thing, like the above, I'd be giving them x time to come up with an acceptable "replacement" before contacting the ombudsman.

what I would also be doing is speaking to the ombudsman about getting your vehicle back on the understanding it Never goes back on the road as they don't appear to be listening one bit about the value and the mods, would the mods be saveable?
Im guessing like braces and suspension would be fine, unsure on the other stuff tho
 
They've already Cat B'd it which normally means you cant buy it back.
I only mention it again as they clearly don't intend on paying out the justifiable value.
Definatley worth speaking to the ombudsman I would've thought.

Does no one on here have a registered breaker as a friend/colleague?
 
I have just got off the phone with the FOS and they cant believe how many things wrong the insurance company are doing. They have suggested I ask them for a final decision in writing and then to ask for the complaints procedure in the same conversation as the woman on the phone has told me she actually wants this one to hurry up to her desk as she hasn't had an insurance company make this many mistakes in a long time.

Lol!! Amazing. Hopefully you get a result you're pleased with by going to the Ombudsman mate!! Sounds like she's going to enjoy ripping them to shreds.
 
Hopefully this broker is as good as her talk suggests :p
Did the FOS say anything about getting the car back?
what about the mods mate, would they be reusable?

It really does sound like they just want to pay out as little as possible.
 
After many days they have finally given me the comparables and they are

Standard 360 on 38'600 miles

Both cars are also sold so I can not go and buy one!!!!

The first one altho stock would be the best baseline to go from tbh, add a little for the mileage then add the mods on top? £22k ish? however, those ad's they are using are private sales. EDIT: just realised that was only a standard 360

What are you actually wanting from them other than your car flatout replced like for like as thats not going to happen.

As another note also when I claimed for my Ibiza they actually stated that they weren't taking into consideration the actual colour of the vehicle unless it was for some high end limited edition jobby. Tried reasoning with them but they werent having any of it tbh.

All I want is for them to base their comparable on an actual comparable not finding the cheapest higher mileage and adjust by £400, when I have found a X360 on roughly the same mileage so base it from there as that gives a true market value and this is from a dealer at £21'000 with no mods. My mods are insured like for like not just for being on the car and I would like them to payout for them as such

They started using comparables which where different models and found an average price and came in at £18'000 and now they are using 2 higher mileage cars and not telling me how they are coming to the same figure.
 
Ive just done some online valuations etc and they are coming in about £21'500 on average for my car on the mileage with mods of course
 
Man this is like storry with my mates R33 that was stolen. He had fresh engine 650hp build top to bottom 15k job. Ofc it was all insured and all. When it got nicked they offered him 6000 pounds !!!!!! Could not get crappy R33 for that sort of money. And that case was dragging for 2 years :/
 
How common are agreed value policies if the car's is so rare like this? Might be worth the extra premium (depends what that is mind).
