Guy got arrested for making racist comments on twitter about Muamba

Nonsense. I'm from North America and grew up with guns around me. For starters an AR-15 is an assault rifle which is not permitted to be carried openly. Open carry laws pertain to handguns only. Secondly, there are so many restrictions on open carry that one can get themselves into trouble very easily. The idea behind open carry is too allow for some leeway in States where guns have always been a part of daily life. However local municipal laws always override state regulated open carry laws. Basically this means that one may not carry a gun openly in an urban area if the city's bylaws forbid it, even if that state allows it.

The intent is to allow guns to be carried openly like they were in the past in rural areas. Even then, if you have an obvious threatening attitude or even hint that your are trying to be intimidating with the gun you can expect the police on your doorstep in no time. Concealed carry is another matter.

Nope it's perfectly legal in a lot of states. Probably not advisable to troll cops like that, but legal.

The last scientific study I saw on the subject of race concluded that there are no races. That is also my opinion. The trivial superficial differences that some people call "race" are not a valid reason for categorising people.

You might want to let all the people with Sickle Cell and Tay Sachs know there's no such thing as race and it's all in their head.

"A person is guilty of an offence if, for the purpose of causing annoyance"

8/10 facebook status updates annoy me...

In the 'what is the real/virtual world' argument. Are computer games virtual word because I'm gonna have to get rid of my keyboard if not :(

I'm going to have to change my playing style at all games as I always try to annoy people to put them off :)

Also a post a few pages back about saying something about someone that they can't change. This is my first rule about banter. It is just bullying otherwise.(I really hate bullying)

All the examples given in their post (really sorry I cant remember who it was) all hold the same value to me.

That said...if someone is up in my face making remarks about me that I can't change, its open house and i'll be calling them all the names under the sun. Though I'm a very level headed/laid back guy and just shrug it off.

On the interwebs though...I really couldn't care.

I wish Muamba a speedy recovery

Has anybody actually seen the comment?

Just read an article, "LOL. **** Muamba. He's dead!!! #haha."

Now I have to admit that isnt a pleasant thing to say by any means.... But how is that racist?

It does go onto say 'When other Twitter users reacted angrily to the tweet, Stacey allegedly responded with a slew of racist and sexist abuse.'

However it does seem this is a bit of media overhype going on here...

The comments under the malicious communications act 2003 don't have to be racist, menacing will do.

The comments don't even need to be received by the intended party. So if the comments are intercepted prior to reaching the recipient then the offence is still committed.

I don't have the case to hand but I recall a case where a man was due to catch a plane for work purposes. Unfortunately the flight was cancelled. The guy tweeted in jest "if the flight isn't sorted in 7 days I'm going to bomb the airport!" he was basically showing his frustration with regards to flight situation. It was clear for all that there was no real malice in the tweet, yet he was arrested on he 7th day as his flight hadn't been sorted!

How many times have you written things in jest about frustrating events in your life? Be careful big brother is watching you! :/

Sorry to go off topic but thought it would help explain the reason for arrest. I do not condone the mamba tweet at all.

Pray 4 Muamba

The guy has made totally stupid comments, but I can't help feeling that the punishment is completely over the top. Not only does he stand a chance of a conviction but I've read on another forum that he has been kicked out of university, with only a few weeks left until his graduation. So, a possible conviction + no degree + outstanding student finance (for nothing) and to top it all his rugby club has also suspended him, an overly harsh outcome for some rash, stupid comments.

The stupid thing is that nothing will happen to the actually racist backlash that has occurred on facebook since that post.

Americans always laugh at how authoritarian the UK is, which always annoyed me as they ignore the many laws they have which are actually the same as ours, But here for once I agree.

edit:

I don't think he'd be graduating from university at the age of 19?

It was absolutely right to arrest him. Not only was he making sexualised, violent, racist remarks about Muamba and he also made sexualised, violent and racist remarks to black people who protested about him.

Whether we like to admit it or not, there's a sliding level of the severity of racism. Some people are racist to a point where they need to be arrested.

I don't tend to care if he's arrested or not. At the end of the day, if you act and talk like a complete idiot I just won't tend to bother listening to, reading, or taking any notice of what you say and do.

I've had "friends" in the past who, when i've gotten to know them, are actually racist scum. I don't bother reporting them to the police, I just avoid them like the plague from now on.

Statement isn't illegal in the slightest. Yet more 'easy' policing, instead of doing any real work.

I agree bout the whole easy policing aspect, dont blame them really but if it puts other people off polluting the internet with their cheap and sick jibes then am all for it.

My family and I have suffered severe physical racism in the past and this lad doesn't strike me as the kind that would go as far as that which is usually reserved for the lower dregs of society so arresting him and maybe jailing him is a bit much. Think community service, (maybe a fine) and a formal apology to the victims is enough really.
