OK, bit of an update. We have spoken to the Diocese and, as thought, it isn't going ot be straightforward. You have to pay £200 for the case to be reviewed by The Chancellor ( some type of religious lawyer for the Diocese). He can say yes or no, but it costs you £200 nonetheless.
If he says yes then it is referred to another body to issue the certificate of exhumation and perform all the neccessary paperwork. However, the ashes can only be moved to consecrated ground. As my Gran and Grandad have stones at the local crem, that is not classed as consecrated ground so we are unable to scatter my dads ashes there. He basically has to go to another church and that church has to agree to letting us do this, and may also charge if they see fit.
We put it to them that the church is up for sale/demolition so the ashes will have to moved anyway, and that would be at the churches cost, but they won't budge on the fee. The way I'm taking this is that they are saying they own my dads ashes, legally, as the law states that once they are interred on consecrated ground, that has to be a permanent thing.
The saddest thing about this, is that my dad said he wanted to live on the street where we grew up for the rest of his life, he loved it there that much. The place where he was interred was on that street. But we know that he will have to be moved at some point in the future and the church where we would move him to was the place where he grew up and spent most of his childhood.
So the choice is, fork out the money now in the hope that the man from Del Monte says yes and get him moved as soon as, or let them re-inter him where he was until such time as the church decide they have to move him. Both me and Mum aren't too keen on him going back into the grave that has been desecrated, as there's no saying it won't happen again and he will have to be moved eventually anyway. He never was a fan of the hokey-cokey. Even if we decide to have him moved though, we have no assurances at present that they will keep his ashes out of the old grave until we have all the paperwork completed, so he could be messed about a lot more yet, which is quite distressing.
So yeah, religious bodies, not my favourite people at present
