Today I learned guilty people never get away scott free despite actually having committed the crime. There are no loopholes, lawyers never question the victims virtue and juries never make bad decisions.

So are you suggesting that the 40% ALL ended with the judge/jury deciding that the woman was lying?

Don't know if you know how criminal courts work but to secure a conviction the jury can only find the defendant guilty if they are 'beyond reasonable doubt' (this contrasts with civil cases where only a balance of probability is required), in other words the jury must be sure the defendant is guilty. Even if they think it was 75% likely he did it they still have to return a not guilty verdict.

Now add in the fact there is some subjectivity to rape and it explains the low conviction rate. Unlike a burglary for example where we know the crime occurred and the only question is did the defendant do it, in rape cases they have to decide if the crime even took place as well as determining if the defendent was the person who carried it out.

I'd suggest in most rape cases it boils down to the man's word vs the woman's and from there it is very hard to be sure to a high probability of guilt.

In short, the low conviction rate is more to do with the nature of rape, the burden of evidence and level of certainty needed in criminal cases and not because there's lots of lying woman.

Shoe on other foot, today i learned innocent people never get charged when they havent committed the crime.

Or maybe that the evidence wasn't sufficient enough to prove beyond a reasonable doubt!! Only a fool would conclude that No conviction = Innocent :rolleyes:

That is far less common and you know it. Frankly the CPS is not going to spend money on a trial it doesn't think it will win.

The victim has to prove, beyond reasonable doubt, that she didn't consent. Unless she was proven to be intoxicated/unconscious/injured that is just her word against his, which isn't enough for a conviction for any crime (quite rightly).

Lol, see what I mean, this guy hates women so much that it has allowed his autistic robot brain to not understand that because someone is found innocent in court, the person who accused them must be lying and that there are no alternative situations that could possibly be in play, how sad.

Take away the female element and I guarentee he would see that some people who are guilty get away with it at trial because there is a lack of evidence to form "beyond reasonable doubt", but because women are involved it must mean "just less than half of women are liars".

The hatred of women flows deep in this one.
