I am wth your comments but one point eludes me
"Several people have gone through the reasoning more than once, including the fact you should never have been able to buy OEM edition in the first place. You manage to buy it cheaply because of a loop hole in the license terms and then complain about the same license terms "

as i have posted before I have xp64 bit which is only avielable as a OEM version ( excluding the trail ) , where do people stand with this one as there is no other to buy,

therfor retail is not an option in this case
 
It isn't much of a loophole anyway - MS have always specifically said that you only need to buy a mouse with XP OEM in order for the license to be legal. It isn't doing anything untoward. But in any event, it appears you can now purchase OEM Windows without any hardware whatsoever, quite legally.
 
You're right, I guess loophole is the wrong phrase. Perhaps it would be fairer to say there are limitations in the license for end users as that particular set of licensing conditions never really took into account end users as such as it was really designed for OEMs.

The point is the OEM license comes with limitations and is not neccesarily end user friendly in design. On the other hand it' is substantialy cheaper and good value if you are happy to abide by the limitations.

It's cheaper for a reason and that reason is it comes with no support or ability to xfer the license /shrug...

Alternatively to take advantage of the "full fluffy MS end user experience ;) " the FPP is the way to go. Good or bad there is no middle version of the package which is transferable but comes with no box/manual/support

Perhaps I worded that a little strongly :)

The upshot is though if the only way to buy it is as a OEM or volume licensing version MS clearly do not see it as a "consumer" product as such. Ultimately that means that yes you can buy the OEM version but then you are subject to the OEM licensing conditions.

For 64bit it looks like that will change with Vista as it will be available in 32 and 64bit versions as OEM, Volume Licensing and retail

the thing is, I'm not sure if this is legal or anything so delete if its not, but you can just RE activate your key like normal after adding new hardware

I think MS just draws the line at the motherboard although it does mention somewhere if it's replaced under warranty or like for like thats ok
 
OK, you can stop panicing now :)

Here's the answer direct from Microsoft UK licensing....

The OEM licensing rules changed in August last year and now any OEM desktop software (Windows OS or applications) must be sold pre-installed on a fully assembled PC.

OEM licences are now available in one packs (as well as multiples) and an unopened one pack can be sold without hardware to another system builder (defined as someone who assembles PC's) so if a user is building his own PC he could legally buy a single OEM licence to install providing he agrees to the terms of the System Builder agreement.

That solves that problem - although Slam62 still can't transfer his license :)
 
Phew! you had me sweating for a bit there, slam likes to change his mboards there the most interesting bit of the whole kaboodle.

Did a search on google and found at least half a doz selling oem by itself, the thing is that blog looks all official and everythin.

What did actually change in september then, anything? :confused:

Damn, this thread has just made me realise how much use I've got out of this copy of XP Home Upgrade I bought back in Nov 2001! It's been dragged through a fair few upgrades and still going strong lol.

It's also handy I have a spare identical mobo for my parents machine with an OEM copy on it. It'll easily last them till they NEED to upgrade to vista (2-3 years at least).
 
Thank god i went down the market.
I think the OS should be registered to your house and allowed on as many computers you have in there just like the TV licence.

Yup - you'd be a complete and utter muppet/idiot (delete to leave appropriate) if you ever installed things on your machine before you'd actually bothered to check what you were agreeing to.

I only ever buy retail upgrade OS's.
Sure they may cost on average £40 - £50 more than the OEM (however over the 3-4 years I'll run that OS that's what, £10 a year - lets call it £1 a month).
However I can move the license as much as I like, I'm a lot less restricted and I've got a couple of incidents with MS if I really need them - perfect.
But there, people want to pay as little as possible and then moan and complain when they don't get the same "rights" as people who paid that little bit more.
 
Get real mate, you must be the only bloke on the planet who does (read the licenses) if its true (very doubtful) then you also lead a sad and quiet life.

As you've read the license and can recite it, does it say that the license is only valid for the life of the machine? ie if i have a 4 year old license and the machine is knackerd (oops) then am i within my rights to but a new mboard and assuming i cant get a replacement an equivelent?

Please answer the last bit even if you get all grumpy over the first bit, remember its just my opinion at this instant.
