That looks like scrappy fodder to me. Hope it goes in your favour. His insurance will probably be void being he was intoxicated :)

i'm pretty sure its voided in terms of his claim - ie the DD will get no payout, but the insurance will be valid as 3rd party only so the OP would get a payout.

I had 2 pretty major car crashes in 2 years I learned a heuge amount from them.

Hope you're alright - the car looks like it's held up pretty well compared to some crash tests/pictures I've seen of Saxos before, how fast were the cars going?

I was doing about 5mph and he was doing about 50mph~ in a 30.

Glad you're ok, and hope they throw the book at him. I have nothing but contempt for people who drink and drive.

Do you remember exactly what happened? Or was it just that he came screaming round a corner and "got" you?

I was coming from a minor road to turn right onto a major. To my right there is a hill in the road and a blind corner where you cannot see anything come over. I checked either way, went to pull out and he came flying over the brow of the hill and I had no chance to react.

I have no idea how my car managed to be so far away, literally 10-15m down the road and in a bush. His was even further. The only way I can think of him being further down the road from me is that I did an entire 360 spin when he hit my front end and went straight through.

He got breath tested and unfortunately managed to pass. He was 'just under the limit' according to the police. They have said they are going to do him for dangerous driving though. I have absolutely no idea what's going on and as far as I know, if he lies, i'll get the blame and come out with nothing.

I'm beyond gutted.

It's a tough call as of course coming from a minor to major road is always looked at as a higher risk manoeuvre - I hope you don't get backlash for this, as from what you say it's hard to say that it's your fault. Do you reckon that if he'd been doing 30 he'd have been able to stop on time?
 
So you pulled out into the path of a vehicle? Granted he was probably going too fast, but unless it can be proved he was going too fast, i think the insurance will favour him.

Also, he wasn't a drunk driver either.

Most definately. He only passed his driving test 3 days ago and the only reason he was driving was he was taking some lass for a spin in it.

It sounds that way, yes. But I didn't really pull out infront of it as it was never there for me to pull out infront of until I had already done it.

I only found out he passed his breath test after I had posted that. He had just been to an 18th party and he said he'd had a drink so I just assumed.

Unfortunately, i think the insurance will only see it as you pulling out on him unless there is hard evidence of him driving like a mad man.

Typical :rolleyes: But to be fair, he wasn't drink driving. Sorry to **** on your bonfire, but i'm not sure there is much chance at all of him being prosecuted for dangerous driving either.
 
I didn't realise you had a VASCAR device fitted to your car to enable you to tell how fast he was going.

Unfortunately, you pulled out into his path, so he hit you. He had right of way and you cannot prove how fast he was travelling (Not least because you don't actually know).

Unless he admits liability I cannot see this going any other way than your fault.

He has already admitted the speed he was going.
