If so, doesn't that mean that he's breaking the law selling that Octavia as he advertised? I'm sure it isn't allowed to sell a car as a trader knowing there's a problem and not declaring it, especially disguising it.

There's going to be something that makes that car worth what it was sold for.

Value is really only what someone is willing to pay for it - you were willing to pay 1200 and nobody else was willing to pay higher. Thus, it's worth 1200 quid. Maybe other buyers spotted something you've missed, I dont know.

People don't tend to sell cars for less than they're worth - would be like me selling my Mondeo for a grand because I wanted a quick sale.

I'm sorry, but this is total nonsense. Sometimes people under value their cars, likewise some people want a quick and easy sale or desperately need the money

I got my GTi for neigh on half the asking price because they seller was desperate. She needed money urgently for a deposit on her first house and thus the sale of the car. I rocked up with Cash, low-balled her and bought it. It is worth more in parts than what I paid for it, but even with it's short comings it certainly isn't a scrapper. In fact I have full confidence that I could serve it up on some classifies for a 'considerable' profit if I wished.

And what about auctions? One example was when I was selling my first e30 on ebay. It got £250 but the buyer didn't collect. I put it back on and it made £600. Are you telling me that the value of e30 316i Tourings shot up more than 2 fold in the space of a week?

At this end of the market under valued cars are common - Owners have already taken the brunt of deprecation and want rid of their car as quickly and easily as possible.

Stop being so suspicious of bargains people! :)

The car was advertised for £1400 - if the car was worth significantly more than that then it would have sold for at least the asking price. If it's worth the asking price, then he's not going to make a profit.

As I tried to explain - value is really only what someone is willing to pay, whether it's a house, a car or anything else. In this case, someone was only willing to pay 1200 quid. Sure, someone may be willing to pay 1400 in a month's time, but I can't imagine it's going to equate to any sort of profit.

No, the sale of goods act still applies to second hand goods. When you're buying from a private seller you will have fewer rights as opposed to buying from a dealer/trader, but if it's not as described (describing a car as 'not using a drop of oil' where in fact it burns it and smokes like a bugger should apply!) or not roadworthy, you're still entitled to compensation. Not saying it would be easy, however. This is all in theory. :D
 
Its not like its gonna go bang after a week, it just used too much oil for my liking and smoked for a while on a cold morning

The skoda was just wear and tear it wanted a new turbo thats all

That said selling a car privatley or trading a car in to a dealer with a known fault in my eyes isn't much different is it ? Your still passing on the problem to someone else.

There is a difference between keeping quiet about a known fault when trading a car in or selling it privately and blatantly lying about the condition of the car.

All are morally questionable but the latter is downright illegal.
