Screwed up

£300 isn't much, it goes up to £2000 and they will fine you that amount.

Minimum fine is £200 + £40 costs dependant on means (if you have a job it is going to be closer to £1000).

The fine and disqualification are set in boundary bands and the fine for the band that 54mg belongs to equates to a fine of 150% of weekly salary in usual cases. The disqualification for that band is 12-16 months (1st offence in last 10 years) but will most likely be 12.

I thought that was a guideline with regards to the fine, if they saw fit they could charge more?

The guidelines for drink driving fines and disqualifications are pretty much adhered to; that is in most scenarios. Similar to the disqualification being 12 months in the majority of cases. However, as i explained in my first post, 'exceptional circumstances' can change the fine/sentence.

Went to the pub at 2pm yesterday and had 3 pints between 2pm and 8pm.

I had a friend who was stranded 10 minutes away so i got into my car to go and collect him, i felt fine, and even asked the bar staff in the pub if they think i would be ok to drive, told them how much i had to drink and in a space of 5 hours and we all agreed i would be ok.

Low and behold i picked up my friend and on the way back i was driving in my Black Ford Fusion as the cops were after a Black Ford Fiesta so decided to pull me and take me to the station to breath test me on the intoxicator machine.

I was told the pass mark was upto 50g of alcohol per 100ml of breath.

2 blank tests were done, giving a reading of 35 and then my turn came which is when i recieved a 54, 3 hours later of me waiting in a cell feeling like a criminal i was charged with driving under the influence of too much alcohol in my system and now have a court date set for the 26th July at 9:30.

I was very courteus (spelling?) to all involved, the office doing the test wasn't sure how to use the machine which filled me with lots of hope :(

Problem is, my car is a company car as i work in the car trade and i have been told that the minimum is a 12 month ban?

This is my first time offence with the police to be honest, i use my car for work, i didn't cause any agro with the officers involved and would be willing to be sent on as many driver courses they want to send me on as long as i don't get a ban, because if im banned, i lose my job, so can anyone shed some light on what im likely to get?

Is it worth me looking for a new job now before the court case to line something up just in case?

Before anyone kicks off, i know i was wrong, thats why im being sent to court, you dont need to point it out, i felt fine, i even double checked with the bar staff to see in their opinion if i was over the limit as they see this kind of thing every day im sure.

As for worrying about your job, well, its all good saying this now isn't it? Your supposed to think of the concequences before not after.

This is what you get for not thinking & helping out a mate I'm afraid, I can see entirely how this situation has arisen, but you have only yourself to blame as you knowingly drove after drinking, pure & simple.

Last Saturday night, I got a late night call from my GF, she was out in town with a friend and she was pretty sozzled by the sound of her on the phone, she was pleading with me to come & get her as she could not get a taxi....

I was so very very close to going to get her, it would have taken me 20 minutes tops, trouble was I'd drank 3 - 4 cans of Bitter over the evening and simply could not risk my Licence & Employment.

I'm still in the Dog house with her for not picking her up, tough **** is my attitude back,as I know I did the right thing.

You don't know how lucky you have really been mate. - Think about it. ;)

If I have to drive up a pub the most I'll have is 1 pint, 3 pints is asking for trouble whatever the time frame :(

I certainly wouldn't get in a car as a passenger with anyone who'd had 3 pints, value my life to much.

You'll be banned, maybe will teach you a lesson....sorry it's harsh, but the drink drive laws are there for a very good reason.

This is the right attitude and I'm sorry you got caugt but it's your own fault. Hopefully they will get more people like you off the road.


/edit: btw, just so you know it was probably the bar staff/manager who shopped you to the police :)

Just for the record (presuming the person you picked up knew you had been drinking) if he still asked you to get him then he's not a 'mate'. A 'mate' would not be so self-centered. I bet he 'feels bad', but hey at least he's not going to lose his job over this.

P.S; Is this thread a wind-up? You've been away for ages then come back with this. I'm dubious.
 
I'm sorry to say but the 12 month ban is the least of your worries, the 10 years that the drunk driving stays on your licence will proclude you from any job involving a company vehicle, as you just will not get insured.
 
I dont drink and drive (not even a sip) When i am driving i am nil by mouth, its not worth chancing.

If i hit someone with after 1 pint (even being under the limit) I am not sure I could live with the guilt.

If your drinking dont take the car... or if you cant turn a pint down go to a meeting.
 
Would all those who have made a serious mistake in their lives please post below, we seem to be swamped by people to the contrary?

I don't think it's that hard to go through life without receiving a significant driving ban or a criminal conviction. I'm sorry if you don't feel its possible.
 
You are correct to a point, it's not that hard. If that was the case though why would we even need police, jails, jury, etc, etc. Given a half chance for rational thought in any situation that might carry a conviction then a good few outcomes would be different. All I'm saying is the guy in his opening post and title managed to sum it all up and explain that this was a serious mistake, which is all I'm saying too.
 
Yup it'll be a 12month ban plus fine.

My Bro did very similar to you, went out drinking about lunchtime at a BBQ, stopped around 5pm, then went to pick his GF up about 6hrs later from a pub in town.

However as he'd drunk a 'fair amount' earlier in the day he was still over the limit when he was pulled over on his way home.

Recieved a 12month ban + £500 fine, got 3months knocked off by doing the course.

Yea but its Aruffel, he'll make loads more similar mistakes. I can't remember a 6 month period without a 'WTF' thread from him.

Fair enough, I don't know him as a poster all that well.
I just got a bit sick of the bashing that was going on even though he'd seen the error of his ways.

Indeed, i mentioned in the other thread it had been quiet without him, shame hes back and bored again really :/
