Screwed up

Yes. Is it really necessary to include so much personal data on a database for life, for such a petty offence? Perfectly acceptable for more serious offences such as robbery, manslaughter etc, but a motoring offence?

A few of the blokes I drink with have had retinal scans done for assault. I think I'm one of the very few in my pub who hasn't had it done.

They shouldn't have assaulted someone then should they?

To the OP, When is your court date, you said in the OP that it was the 26th of July, but that has already passed.

Sorry, 26th August

Late night :(

Andy

Had a few beers did you? :p

Simple way to calculate alcohol intake and dissipation, is that a weak lager (4%) is about 2.3 units a pint. Strong lager (5%) is about 2.8 units a pint. Alcohol dissipates from your body at 1 unit an hour (roughly) and it takes an hour for this to start working.

So if you had 3 pints of Stella (2.8 units a pint) then that would have been 8.4 units and would have taken over 8 hours to dissipate from your system.

Maths is fun :D

I was told the pass mark was upto 50g of alcohol per 100ml of breath.

'Fail' is 36mg.

I was very courteus (spelling?) to all involved, the office doing the test wasn't sure how to use the machine which filled me with lots of hope :(

didn't cause any agro with the officers

The police and courts see a lot of courtesy and politeness in similar cases, strangely enough, but unless there are mitigating circumstances it won't win any favours as they are oblivious to it. Mitigating circumstances would be something along the lines of you have disabled children, your family will suffer due to your inability to drive them around etc. However, if you are cocky in court, which it is clear you won't be, it won't help your case.

i know i was wrong, thats why im being sent to court, you dont need to point it out, i felt fine

Feeling fine doesn't equate to being able to drive unimpaired.

i even double checked with the bar staff to see in their opinion if i was over the limit as they see this kind of thing every day im sure.

Won't help your case unfortunately. If you brought them into court as a witness that would mean a trial and an increased sentence, as well as proving fruitless.

This is my first time offence with the police to be honest, i use my car for work, i didn't cause any agro with the officers involved and would be willing to be sent on as many driver courses they want to send me on as long as i don't get a ban, because if im banned, i lose my job, so can anyone shed some light on what im likely to get?

The disqualification period for the level of alcohol you were measured at is 12-16 months for first offence in 10 years. Likelihood is that you will be given 12 months. The magistrates will probably offer a drink driver awareness course. If they don't then tell them you want to mend your ways and ask to be sent on one. This way you should get your license back in 9 months. You are also likely to be fined 150% of your weekly income.
(My feelings are that this course would be good for you as it seems although you were over the limit, you feel you were still OK to drive).

Hope that helps and i hope you will have learned from this experience.

My mum and dad are both disabled, is it worth stating this in court as even though my mum drives, i normally have to take them places most of the time.

Mines faster than 1 unit per hour :D

Someone at the local bar bought a breath test unit as a bit of a gag. We had a mini competition to see who can get the most wrecked before passing out/being sick.

According to the machine mine was going down 3 units roughly every 1 and a half to 2 hours.

Also managed well over 60 units of alcohol without being sick or feeling "too" bad.

On the saturday we went out, had a big fried breakfast sunday morning, went biking (push bike on rocks), had a pub dinner (no alcohol) and at 4pm on the monday afternoon i was still over the limit.

You'll go to court, you'll be fined and given the disqualification. After this, you will be able to tell the magistrates of your 'exceptional circumstances.'
The magistrates aren't stupid and you will have to give full evidence of needing to care for and drive your parents around from the likes of social services and/or your doctor. Prepare to be grilled as the magistrates' sympathy with you will start at a minimum. If you feel you have a real case would advise hiring a solicitor who will advise you similarly. I'm not going to give any more advice on this as i feel i've given enough and the case should be judged on its merits. Also legal aid is not an option as the offence isn't imprisonable.

Dont tell me you are going to worm your way out of it, shouldn't you of thought about them before you sank 3 pints of lager and went driving?

Shocking.

Not being funny but I would never drive after more than 1 pint, even if you "do feel fine", isn't that what everyone says..? They will be a bit lenient if you need a licence for your job though?

Yes, and my girlfriend's dead because of a drink driver. Take the punishment you so rightfully deserve, and learn your lesson.

What I can't understand is this.

Why did the police take you to the station, breathalyse you, charge you with drink driving and then take you back to your car where they breathalysed you again and allowed you to drive off?

Becasue he has only been charge with the offence, he is on bail.

I have had the exact conversation with my best mate today who is a Police Officer.

On Saturday he had to tell a family that their mother, daughter sister was killed by a driver that blew just shy of 100.

Do you know how many innocent people are made disabled by people like you?

I hope they throw the book at you. Criminal.

This is why you need to be taking advice from a qualified legal professional rather than a bunch of forum jockeys.

Why should they be more lenient on someone who needs a car to work? Surely those people should be more aware of driving while intoxicated as they have more to lose.

I know a guy who wanted to become a paramedic, but a couple of weeks before his application went in he got caught speeding by a static camera. He now has to wait 3 years before he can apply because he needs a clean license. Speeding around a static camera is stupid at the best of times, but when your career depends on it then it's just reckless. To me, it's pretty much the same situation, if you care so much about the job in the first place, don't do things that will risk your license.
