The advice given has been noted and some even actioned. Other comments/advice like yours in fact isnt helping anyone and is just showing what a complete arse you are.

Fair doo's you wouldnt handle a situation like this... but its all a learning curve and next time i wont be so gulliable. I admit, i havent made the situation any better... but the least i need is nobs like you telling me what an idiot i am and how im this ant that... just said really. I dont know why you have such a bad attitude but just chill.

and for the fifty'th ****ing time... if i had gone through Paypal i would have had my refund in 20 days (maximum). But i never, so.... currently i have to deal with this the hard way.

But theres no point getting nasty yet because the evidence i have isnt the best... and without speaking to my solicitor before Monday anything i say or do to him could jeopardize the whole situation.

If you have all the evidence, stop flapping about, give them a 14 day warning then go to small claims court without further notice.
 
Do you know what he said aswell after i phoned him lol...

I said "just to let you know Phil, once again......... no cheque"

He didnt sound suprised...

I then said "Phil, at the end of the day i have given you a lot of opportunitys to resolve this matter... and you have bean leading me on for a while now, ive been patient and waited 70days. Put yourself in my shoes.... I have your jeans and your money... would you let this go on for 70+days? I am losing all patience now and all i can ask is have you even sent it???

Phil replies "I cant believe your saying this Luke, i cant beleive your accusing me. We are a registered business and cant afford to work like that"

I turned round an laughed and said " look mate, youve told me on several occasions i would be receiving the refund that very week, ive not accused you either... im merely asking the question in which we both know the answer to"

Phil says "wait till monday and let me know if it still hasnt arrived and if not i will get another cheque signed and sent special delivery and will give you the tracking number"

so... either way im still contacting my solicitor on Monday because the office is closed today. The solicitor is actually aware of the situation and has said to wait and give him the final opportunity. But even the solicitor said i cant see it turning up because why post standard 1st class.

But saying that, me being an Estate Agent, when we send our invoices and the solicitor sends our cheques... they can sometimes get lost in the post (very rare) but does happen even if there only a 5 minute walk away lol

I can't think of a nicer way to say this but you should not be in business. Try something else.

Jesus Christ man, stop posting drivel on a forum and get down citizens advise, followed SWIFTLY by the solicitor.
Stop talking to the moron on the phone and DO something, instead of sitting on your ass waiting for a non existent cheque to turn up!
 
He'll probably claim to have sent the cash through the post this time when he sends special delivery. Then you'll sign for it, see there's no cash and he'll have won once and for all.
 
You're 20 years old and earning 45K+ p.a.! Now I know that when I was 20, if I was earning that much I'd have so much disposable income that I wouldn't know what to do with it. So, why not use some of your income to take legal action and stop acting like a mentalist?

Or, get some of your ex-army buddies to pay them a night-time visit.
