Speed Cameras

Humour me here, say we all said "stick it to the man, fight the system!" how exactly would he go about getting off?

The fact: he was caught doing 46 in a 40.

What technicality is there?
What loophole is there?

If was no camera sign or he had to speed up to avoid an emergency vehicle or something I could see a possibility but he seems very much banged to rights with this.
 
I really dont know much on the subject but I belive the technicalities he can look at include....

Was the camera calibrated within its set service period.
Was the NIP sent within 14 days
Is ALL of the information on the NIP correct
Demand to see a photo from the camera to help you identify the driver


Not sure now but as I understand it you used to be able to return the form with only part of the NIP signed. I really don't route at all but have heard of people using it to get off in the past.

This is probably related to the ECHR law that it is illegal to force an individual to incriminate themselves. A law which the police do blatenly flout when it comes to speed cameras.

In terms of what an actual Solicitor would do to get you off I have no idea but I have met people in London who have paid professionals and had convictions thrown out. Sure it costs them mucho £££ tho.

In terms of illegal loopholes that are easy to exploit you can sell your points to someone else to take. Or blame it on a relative abroad.
These routes of course are far more difficult to justify moraly, however if the police used actual police on the roads rather than machine to do their job it would stamp this out instantly.

If everyone in the next week who was sent an NIP in the post decided to go to court as a form of protest due to the unfairness of NIP's and speed cameras the system would be unable to cope and colapse

What kind of camera was it? If it was a GATSO (flashes from behind), they're you're laughing. In order to get a successful prosecution they have to identify you as driver of the vehicle, this cannot be done from a photo taken from behind the vehicle - so how do they get you? They get you to fill out a form admitting your guilt. But... you don't have to.

What you do have to do is send back your details, but you don't have to use their form (this has been tested in court) and because they haven't read you your rights they don't have the right to use it against you in court (in the PACE act, again tested in court) so what you need to do is send back a letter with the form (filled in with "see accompanying letter") with your details on it saying they can't use it against you in court.

Google up a 'PACE declaration' and stick it to the MAN.

It was taken from the front, and I already am aware of the PACE thingy and about the machines needing to be regularly calibrated etc

I do note my spelling mistake, but I blame Bill Gates for that ( I hope you didn't write in red pen all over your screen ).

Hmm ....... I think I'll wait for their response from the letter. Gives me another week before I need to write the cheque.

I'm sure I'll get the fine and the three points, but credit for trying? or not !

Oh yes.... about the implants...... i didn't mean the silicone variety, I was meaning of the future when people will be implated with some kinda semiconductor device for identity purposes or for buying and selling ( yes rev 13). I won't be first in the queue for that one.
 
What should you learn from the experience of being caught speeding? To be more aware of where the speed cameras are, so you can slow down a little more there, to speed up afterwards.

The day I get caught speeding by a camera at anything less than 50 over the limit, whilst drunk, I'll feel very disappointed in myself. I'd have failed in my mission to intentionally speed and get away with it :(

These speed awareness courses also seem a bit silly to me. People must surely be aware of roughly how fast they are going. Is it essentially a course on how to read an instrument? :confused:

nope, its quite an informative course imo, most of the people on mine had no idea about half of the questions that were posed (nothing hard, just general driving knowledge that all should know really) and ony 1 other knew 'only a fool breaks the 2 second rule' saying, or how to know you are in a 30mph zone, what the differences in the central white lines mean.

I dont have any of the info anymore, it was in the boot of my BM. Though I am tempted to ring them up and ask them for a copy on email, would be interesting reading for a few people on here imo.

I'm quite shocked tbh. But then, I suppose it's easy for me to preach, as I only took my test a couple of years ago and maintain an interest in cars and driving, so it's still quite fresh in my memory. I'm fairly sure my mum and dad would get the two second rule and the line layout, but probably not the limit identification.
