No, you're not eligible for this offer. You need to have a licensed copy of a previous version of Windows if you wish to purchase an Upgrade license of Windows 7. This here, here or here is the copy you should be getting, depending on which edition you need.

The Vista I have installed has got a key but it has been thrown out. I have an xp disk I got with the pc though. Could I use that? Or would I have to install xp first and then upgrade?

It can't only be an upgrade edition. It talks about the possibiliy of upgrading from XP to W7 Home Premium and says you have to do so via a clean install - which these discs allow you to do.

Was head scratching myself before I noticed that. Either version allows a clean install according to the FAQs, they're just talking in terms of upgrades because they assume people with Vista Home Premium are upgrading to W7 Home Premium etc.

Would Open University students doing a part-time course be eligable for this? My guess is no.

Well I just ordered a copy of W7 Pro for £30 as my other half is enroled in the Open University. All you need is an email that ends in an acceptable (academic) domain - e.g. .ac.uk, so I guess that you are eligible.

As to the upgrade/full retail question, just because you have to/can do a clean install from e.g. XP does not mean it is a full edition. You can do a clean install from all upgrade keys so long as you do so from an activated copy of an eligible MS OS. My bet is these keys are probably going to be upgrade only. The best question is can you upgrade a non activated version of W7 as you can in Vista.

This is confusing to say the least, but I get the impression that this version will not be a bootable iso image like some people are expecting. It will simply be some sort of install exe file and it will need to be run from your current Windows operating system.

The mention of "clean installation" is simply referring to the case where the Win 7 installtion program detects a current Windows operating system that can't be upgraded and will be wiped before Win 7 is installed.

Either way, you definitely need a valid Windows OS already installed.

Hmmm, will be bit of a hassle installing onto a new computer, but still worth it over the full retail price.

Im not so sure you need a valid OS installed though! Why do you say that?
