Stupid Yapping Dog

Same thing happens with my neighbours dog, just never stops barking!

Next door are fully aware that it bothers me because many of mornings I have opened my window and shouted at the top of my voice "shut that ******* dog up!!" to which the lad owner comes out, shouts at the dog and brings it inside......She must fear for its safety!

I heard that someone else on our street reported them for it because it was literally all day and night.

I does raise the question of WHY have a dog if your going to dump it in the garden all day and night?

Some people are just inconsiderate fools :)
 
It is somewhat bigger than a Yorkshire Terrier but still small.

It seems to be that the smaller yappy dogs are always the most lairy. When a cat sits there and watches a dog yap at it you know there is something wrong. My aunt's alsation used to make a cat **** itself at 100 feet..

The dog seems to roam freely between house and garden so I assume that they have a cat flap type thing for it.

How do I complain about noise nuisance?

1. Tackle the Source
First, approach whoever is responsible for the noise. They will often not realise they are disturbing you. The majority of noise complaints are resolved informally, and you may well get a quicker result than if you wait for an official to arrive. In cases where you might feel threatened, or where previous personal approaches have not worked, go to your local authority.
2. Complain to the Local Authority
Contact the environmental health department of your local authority. They must investigate your complaint. If they agree that the noise is a nuisance they will contact the offender – informally at first, but with an abatement notice if necessary. If the offender fails to comply with the notice, proceedings can be taken in the Magistrates Court (Sheriff Court in Scotland) or an injunction sought in the High Court.
3. Mediation
Many areas have mediation services who can help you resolve noise disputes. Again, this may often prove quicker than the legislative route, and is useful where there is a problem, but a statutory nuisance cannot be proved. Your local authority should be able to put you in touch with a mediation service if there is one available in your area.

If these fail…

1. Complain Direct to Magistrates
As an occupier of premises affected by noise nuisance you can complain directly to the Magistrates Court under section 82 of the Environmental Protection Act 1990. You may do this because you do not wish to involve the local authority or because you have not obtained satisfaction from them.
2. Take Civil Action
Civil action can be taken if you demonstrate that the noise nuisance substantially affects your health, comfort or convenience. It can be expensive and it is wise to seek legal advice. If you win the case you will obtain an injunction to stop the nuisance and can sometimes claim damages. Civil action differs from Magistrate/Sheriff Court proceedings in that judgment is based on how the nuisance affects others.

Proving that the 'best practicable means" have been used to abate the noise is no defence, except in cases involving noise from trade or business premises.

In extreme cases…

Neighbour noise can be part of a more serious neighbour problem. Under the Housing Act 1996 social landlords can take action against tenants for anti-social behaviour. The Crime and Disorder Act 1998 gives councils the power to issue an anti-social behaviour order to anyone causing "harassment, alarm or distress" – this can include noise. Disobeying an order carries a prison sentence of up to five years.

also we use rat poisin to kill rats, a ratty dog is no different surely :P ?

People who put rat poison down are reckless idiots, they have no control over where it may end up because it gets trawled around by the rat or eaten by curious cats. Use a trap.

A women up the road lost her cat to rat poison.
Now if somebody wants to be the person who did a thing like that then they are the most alpha person on here, because she and all her brothers were ready to rip the living **** out of the culprit :eek:

I sympathise, it took 14 months for us to get our ignorant neighbour to shut his alsation up, best thing to do is to go round their house and politely inform the owner that their dog is causing a noise nuisance. If they get all arsey about it, tell them that you've been reasonable with them but your next stop is Environmental Health.

If the noise continues then ring your local council, Environmental health will write the owner of the dog detailing the action that'll be taken if their dog constitutes a statutory noise nuisance and will normally ask you to keep a diary of when the dog barks (you need to keep an accurate record as it might end up being used in court).

By this time most reasonable owners realise that they're being a **** and do something about the dog, if not, fill in the diary sheets you've been sent, send them back to Environmental Health and follow up with a phone call to say the noise is still occurring, they will write to the owner again to state that they'll be setting up recording equipment to monitor the dogs noise and if necessary they'll take the owner to court (max £5,000 fine I think).

If this doesn't spur the owner into doing anything then you're **** out of luck, luckily for us someone appears to have intimidated our neighbour, the following day he disposed of his mutt in a hurry.

I absolutely, positively cannot recommend that you accidently lower a bowl full of anti-freeze over the fence, they love the smell/taste of it apparently and it kills them very quickly, but seriously, don't do it.

Do NOT do this, the chances are you won't be able to demonstrate a noise nuisance, you'll lose the case and have to pay court fees. Your local Environmental health will take him to court if it's deemed necessary.

I never said I Wanted to, I wouldnt use rat poison on rats let alone any other animals, the times when we have issues with rats coming from the farm I just use an air rifle, Im also a cat lover. I thought you were just saying it in a way that meant rat poison was fine for rats but other animals were somehow different
 
Calm down lol, a few animal cruelty jokes never hurt anyone.

The dog in question seems to have either been kept inside today after I told it to shut up this morning or it is out on a walk. Either way there is peace currently :D

Phone up police non emergency and complain.
Do this every day.

If you're lucky, the dog will be taken away and destroyed and the owners will learn.

Edit: Could always keep throwing chocolate over the fence for it to eat.

People are ********, if it has even got to this stage it is clear the owners care nothing for the well being of others. Besides, the pitiful creature is better off dead. Rat poison all the way, all the hippy homos can suck it. :)
