As an update my (currently) 6 page complaint is now with my solicitor detailing in depths the failures of the officers and will shortly be sent over to the west mercia police standards department and their legal department.
 
Well pretty sure my battery is on the way out, havent driven the car in 5 days and this morning went to get some shopping and completely conked.

Time to get an anti-gravity battery ordered.
 
lol, reign it in. This isn't ever going to go to a high court. At worst, Susan, who has nothing better to do an a Wednesday afternoon, will put on a wig and decide if either you or the Police are right at your local courthouse.

I'm afraid you need to brush up on your law :) A section 59 warning has no built in appeal or review procedure. Accordingly if you intend to challenge it the only way to do that is to apply for Judicial Review, which, happens at the High Court.

Thats assuming the local plod want to uphold the warning :) Im betting the moment they open up the video evidence, they'll fold like wet paper.
 
When you say video evidence, is this solely from the Police bodycams or is there another source?

Yes, and refused stating that until I had time to read the documentation and check the relevant laws I wasnt happy to sign/accept it.
 
Were your actions, out of interest, at the time, those of a careful and competent driver (irrespective of other road users nearby)? If not, yikes. Lube up, buttercup.


I was in full control of the car at all times, well within its capabilities (didnt even make it into peak torque powerband) and my own, and posed no danger to anyone including myself.

Im not sure a 2 second blip of the throttle on a straight bit of empty road leading in and out of a carpark is ever going to pass for, well anything really.

Thats why they had to peddle backwards until they got all the way to "inconsiderate driving". Which even that fails to meet the standard to apply.

But whatever, it's not my life.


So far ive spent more time talking about it in this thread than actual time and effort spent on holding them to account.
 
Out of interest what will your defence be for blipping the throttle?

There has to be an alleged offense in order to issue a defense.

There is no law on how quickly you can accelerate your vehicle to the speed limit as long as you are complying with all other relevant driving laws. So its an entirely moot point. If there was every single tesla owner and every single motorbike owner would be in trouble.

Not at all, but im not going to lie down because some officer with a stick up his backside one day wants to be difficult.

A S59 cant be used as a generic "catch all for everything". They have standards to uphold and in this case, they got it grossly wrong and then have been caught lying about it. I will hold them to account for it, which is what everyone should do if they believe they have been unjustly dealt with.

The difference is, most people dont have the means (£££) to do so, however I do.
 
Eh? Isn't it like £150 to file for judicial review? And, should it get further, which is unlikely, it can cost a bit more


The first hurdle is you have to apply to the court to get permission to file for the review.

And yes, its cheap.

However, if the police want to contest it, and put an opposition in, if the permission is refused you are potentially on the hook for their costs of preparing the opposition.

Which can be substantially more, potentially a few thousand, which is why most people would back down at the thought of potentially being liable for that amount, and why justice is not available to all.

And as per all my other car ownership threads, I keep people updated on the day to day of such ownership, servicing, events I do, interesting stuff that happens. Seems to be a recurring "issue" for you for some reason. Feel free not to follow them if they give you angst.
 
So renewed the warranty on the car today.

24 month policy, all the same bells and whistles as the previous one, same claim limits etc. £2500.

Its a no brainer really, 1 thing has to go wrong in the next 24 months or need replacing and its basically going to pay itself off.

Meanwhile, they want to sell my car, an indication they have a buyer lined up as they can get the money in my account within a week apparently. For £17000 more than I bought it for after ive stuck all those miles on.

I'm not going to lie, that is a bloody tempting proposition. But, realistically what im looking at has gone even more insane price wise, so it would be a sell it, buy a crappy runaround for 12-24 months and then hope prices come down and win both ways.

But.

Id rather be driving a lambo. So car is staying :D

This is a dual remote lens setup to keep it hidden away and stealthy.
 
As you may have noticed, a few times now the battery in the car has died.

After checking, it still has the original factory battery installed, which doesnt seem to be doing so great at holding charge and never seems to get onto maintainer mode in ctek anymore.

So, ordered an Antigravity replacement battery. 40AH, 1500CCA. And rather than being close to 20kg, it is instead a tad under 5kg.
