Quite so. There was something in the daily mail recently who applied the sale of goods act along with some European directive stating you can have anything up to six years in which to return a faulty item. The item in question was an lcd tv out of manufacturers warranty.

As far as I can remember, the European Directive gives consumers 2 years of protection, but its our own Sale of Goods Act that gives up to 6 years reasonable protection. Our own legislation in this case over rules the EU one.

Chances are that if you contact o2 now they'll offer an upgrade to the 3g. A girl at work had the same thing when her original iphone started playing up. If you can though, it might be worth holding on until the new one's released.
