The nervous wait to exchange....

I actually emailed my solictor asking if he needs any information from me?

Including info about where my deposit has come from (my mortgage advisor suggetsed I ask if they need that as my bank shows a large cash deposit recently and the solictor may need to do additional work for anti-money laundering)

I emailed yesterday at 10am, no reply yet.
 
Thought I'd join this thread to help spread my pain :D. We're now officially in a small chain, have a buyer with nothing to sell for our house, we're buying a house where the sellers are moving into a vacant property so hopefully will be fairly simple and smooth (ha haha hhahahahahaha yeah right). Time for the annoying job of getting the mortgage finalised and no doubt some bunch of useless over payed solicitors involved.

I got a reply, I have emailed him some proofs of my deposit that shows it's not MAFIA or drug funds. Lets hope it's enough.
 
Hit a snag. Until Friday I had only been told of service charges to the freeholder. Found out over the weekend that there is another management company who looks after the externals/landscape, etc. Suspect estate is private and not looked after by the council. The extra few £££ don't bother me but more the fact it hasn't come to light until time to exchange. So my solicitor has asked me not to complete until he has 100% confirmation there are no other nasty surprises.

Question for any of you who are more property law savvy. The seller didn't disclose the separate charges payable to the externals/landscape management company. The EA didn't know why it hadn't been mentioned before in the seller's property information pack.

My dad reckons I should make a fuss of it after all. Any thoughts?

Will ask my solicitor tomorrow. I mean, it's not going to stop the deal but my dad reckons it's legally dubious.
 
Just heard from solicitor, they want me to go in and sign some paperwork/contracts. Have been told a date of 4th of december for completion should be achievable!! :D
 
So we finally exchanged contracts on the sale of our old house and the purchase of our new house. As we're buying a new build it's not going to be ready until end of January, So we've had to move in with my parents and put most of our stuff into storage for a couple of months.

We're due to complete contracts tomorrow. But i asked our solicitor for a money in and out statement type thing, so we knew where the money was going and how the left over money was calculated. I'd already done some quick checks as i've listed most of the incoming and outgoing monies myself.

We're buying through the help to buy scheme so only need to provide 5% deposit which is what we've set our mortgage up with. House is £252,995. So £12650 deposit, and £2650 stamp duty.

Anyway, got a statement via email this morning. All the fees for the sale of our old house are on there, the mortage settlement, and then £6500 for the deposit on our new build. No mention of the remaining £6k deposit, stamp duty, or fees for the puchase of the new house.

So basically, were getting a cheque for about £10k more than i was expecting.

Is this normal, or have they made a mistake?

I'm not worried that we're going to lose the new house or anything like that. But i'd expected the solicitor to keep all the money required for fees, deposit and stamp duty, etc. Then send us a cheque with the remaining money. Seems a bit silly asking us to transfer around £10k extra when we've already exchanged contracts on it, and they've also kept aside £6.5k for the deposit.

No chain either side, so hoping to start moving towards the end of January.

As we're keeping the flat we'll be able to clean the place and do the couple of changes we want and decorate without having to move stuff around.

We do have to demolish the 2 sheds. They're both rotting and starting to lean quite badly. Nice metal shed will take it's place later in the year.
 
Had a letter from the mortgage company we're using for our purchase on Friday.

Said they were sorting out the valuation. They also understood we were buying a new build or this was the first occupation of the property, so please detail all builders incentives otherwise funds might be delayed.

Erm, the core of the property we are buying is almost 200 years old :rolleyes: :D
 
Instructed solicitors today and got the mortgage process kicked off. Rang round a few solicitors that were recommended and chose one based on response time and this was something that had been highlighted to me before I contacted her "She's very quick to respond on email". Let's hope that doesn't change!

My only concern is that we used another solicitor at this practice 8 years ago and he was really awful, but generally they are well known to be good so hopefully that was a one off.

Trying not to get excited yet as there is so much that can go wrong.

Removal men started taking boxes yesterday!

Exchanged on Friday with Completion this Thursday. Just hoping they don't lose anything now :-)
 
All credit checks passed, mortgage agreed in principle and I have a meeting tomorrow with the mortgage provider to decide which product to go for. :)

My saga is dragging on. I heard back from the solicitors today about the final sticking point. The vendor has no proof of planning consent for the extension but says he can confirm it was given. The solicitor has recommended an indemnity insurance against it but the vendor is unwilling to pay. It was 25 years ago so the chances of any come back are pretty slim.
 
Has anyone dealt with a buyer that's getting a lease extended on the property they're selling?

Ours is apparently getting a draft lease agreement early next week to sign and then its being sent to the Land Registry but I've no idea how long that process would take.

Any experience? We agreed our own sale back in June/July and we've only just found out about this in the past week or so..

25 years is 'take a view' territory. Always good to ask the sellers to pay but if they refused and it was that long ago I'd be cracking on anyway unless it was something really major.

Potentially bad news but if they are surrendering the old lease and granting a new extended one it could be quite some time at the Land Registry. Anything other than bog standard registered land transfers can take an absolute age at the moment.
