I cant imagine it being stable with battery life reducing over time..
I can't imagine why not? Surely it should be as stable for as long as there's power to run it.

So its nearly a week and I have had to phone them to ask where my Case is at this point, appently the case is STILL jsut stiiing "open", so no movement at all over a week, and being told typically I will have to wait longer now until they phone me, then if it goes as normal I have to ship it back to them, so god knows how long this will take over all.
Very VERY disappointed/ angry at this point.

Why did you have to phone them. What exactly are you expecting? Repair and return within a week?
It's going to take atleast 2 weeks.
After we have shipped back your Surface Product to you, if it arrives in a damaged condition, you must notify Microsoft of the damage by calling us within two (2) days after you receive it (at the customer service number listed on http://www.microsoft.com/surface/support/contact-us/ for the country where you purchased the Surface Product). If you fail to contact Microsoft regarding any damage to your Surface Product within two (2) days after you receive it, you will be responsible for any damage.
What would that do?
