The Post Office gave my parcel to someone else and won't refund

They are only supposed to hand it over if you have the card plus an id with the correct address.
And my gym should't allow me access unless I provide my membership card but they do. I was just stating they're most likely infringing on internal policies when identifying individuals via other means, not committing a crime.
 
Quite frankly OP I think you're taking the pee. Going to collect the item 2 weeks after Christmas and then dealing with it now is nothing short of negligence.
 
can we be a bit nosey and ask exactly what the item is for £50? for me that's the most interesting part of the thread

(also may give a clue as to why another person kept the parcel if given to them accidentally)
 
Actually yes, the seller has a tracking receipt from royal mail, in Paypal's eyes that is proof the item was correctly delivered.

It will be very hard to convince them otherwise.

A tracking receipt which actually proves that the parcel was not delivered to the intended recipient (unless they signed a fake name).

She called them up and she didn't get it because they apparently said they would find in the seller's favour, because he fulfilled his obligation by posting the item and he has proof of that. They apparently said there is an option of requesting a refund through the bank but there's a time limit of 120 days on that so she's SOOL.

What's the next thing she needs to do? Call back and demand to go ahead with the refund request? I.e., because they can't possibly find in favour of the seller if they can't present proof my aunt signed for the parcel?

Check policy. I don't think they need proof of signature if it's below a certain amount - only proof that it was delivered/delivery was attempted. How do they know your aunt didn't collect the package and is just trying it?

Because the PO have acknowledged that my aunt was never given the package.
 
Is there not a RM ombudsman? Are you NOT able to challenge their initial response?

I've had to collect scores of parcels from the local depot, the card would show my name, parcel the same. My wife has collected each and every one of them on her way to work and never has she been asked for ID.

We once had RM SDE containing passports and Indian Visa left on the depot shelf, we contacted the high commission and was advised that passports had been returned 4 weeks earlier, we did a tracking and they had been signed for by someone else unknown to us. Next morning we went to the depot the RMSDE was on the shelf. RM stated they'd come to deliver and left a card then 2 weeks later came back to the house and obtained a signature! My reply was, if you obtained a signature why did you still have the RMSDE on the shelf gathering dust?

I've had recorded delivery stickers peeled off packages and the package left in my open porch, I've delivered dozens of letters to neighbours when they've been put through my letter box in error. Only last week I was talking to my neighbour when the posty came along, handed me some letters, the same to my neighbour. I had my neighbours letters, she the next door down and the posty had to go back to the house the other direction to retreivemy mail! Shambles
 
I know it's sometime hard to take a loss.. and no one should just have to take "it". But from experience, sometimes it's better to just call it a day rather than getting stressed out over and over again.

The whole thing sounds messy and it can and will take an age to sort out.

Besides they wouldn't be able to claim for this after this long.

It's definitely your responsibility to sort this immediately after you knew of the problem

You knew there was a problem half a year ago

If I was eBay I would find in favour of the seller.
If I was you I would just let the 50 go.

Of the three parties (rm, you, seller) the seller is least at fault with this RM fail

Seller was contacted months ago. Refused to help. Told my aunt to speak to PO. She was given run around.
 
Chalk it up as an eBay loss.

This, seller did their part and so did your aunt to a degree. It's crap but there is nothing that can be done now.
In all honesty though if your aunt didnt know what she was doing chasing this she should have sought advice sooner and not months afterwards.

She has a right to be mad and upset but there is nothing she can really do now.
