Whether it’s a penalty or not needs to be based on factual circumstances.

If it’s wildly different factual circumstances, it’s not really the same thing :p
Adding more subjectivity to the sport in the worst way of going about it. Changing what is and isn't an infraction based on the ref's opinion would be worse than we have now. It's like the people who have a problem with the offside tech, it's mind boggling.
And that's why all the ex players and most of the fans hate the new rule, it simplifies it too much
Ex players and fans aren't the benchmark you think it is :p.

So the benchmarks is the Uefa suits?

The reason it's silly is because everything becomes a pen. 2 defenders jumping for a header, brushes one of the defenders arm, penalty. Defender closing down a cross, scrapes his hand, penalty. Attacker purposefully kicks the ball into a defenders hand, penalty.

It shouldn't be the likes of Jenas and Rio, or the guy behind me at the game complaining about VAR when his teams goal was being checked, and screaming for VAR when he was convinced a clearly onside player was offside anyway.

Every infraction has always been a pen in the box. It didn't brush his arm it was outstretched and deflected a cross.

Applying strict rules to chaos leads to unfair / harsh decisions. That’s why in ‘law and equity’ you have equity to balance out the harshness of the law.

In the context of the game, it should be the case that the more serious the impact of the handball would be, if it occurred, the more the hypothetical handball should be considered a penalty. In addition, there should be some relief for accidental / incidental actions, in all but the most extremely impactful circumstances (such as handballs on the line that are 100% blocking a goal - in that case OFC it should be a penalty).

Yes there is inevitably some subjectivity in that but the idea is that you can achieve the greatest fairness overall by having some wiggle room.

The International football scene is fast closing up when it comes to ability. The quality is improving from so called lesser football nations. Compare this to the PL and it just shows how it should be when money is removed

Guess we'll have to agree to disagree. There will always be harsh decisions regardless of the rules (Instead of arguing about what is and isn't a handball it'll be what is and isn't a penalty) and fans will always complain, as evidenced by the sheer amount of complaining about the fairest and most objective offside system we've ever had.
