Want to appeal a Yellow Box PCN

If the maximum speed limit is 70Mph and you're travelling at that speed in the middle lane,

The issue is, you may be doing 70mph indicated with a 10% over estimation on your speedo.

The car behind you may be going 70mph indicated on a 5% over estimation, therefore going faster than you, you are therefore holding him up and should move over.

Moving to the left when able is a requirement, not a request.

That and your supposed to sit in the left hand lane if your not overtaking anything anyway.
 
I want to dispute it for the following reasons.
  • The location of the alleged contravention is incorrect. PCN states Neald Crescent when in fact it is Neeld Crescent - confirmed by OS.
  • The first photograph does not have the registration of the vehicle.
  • There are just 7 seconds between the photo of the vehicle waiting at the edge of the junction and the car passing through the end of the box junction. There is no proof that the vehicle was actually stopped in the box junction.
Not to mention the fact the box junction has broken lines and is a general poor state of repair, and £130 fine is totally bloody disproportionate to the offence.

The fact the photos don't prove he stopped is a valid point and if they don't have any video footage could help (obviously if thye do he's bang to rights). The other points mentioned are childish attempts to get out of it and would only serve to annoy/anger anyone looking at the case.
 
It's irrelevant, the car had to be out of the way before he entered the box.
That's not how it works, the exit has to be clear, it doesn't matter if there's another car between you and the exit (unless it looks like that car is going to cause a blockage at the exit). The highway code guidance actually shows two cars crossing a box junction with a clear exit.
