What happens now?

Apparently the copper has to give the details of the other party by law incase of any insurance follow up.

I have got hers too.

Good idea, I'll suggest that to them.

Well no other news from the police as yet.

I have rejected liability and have told my insurance that if I'd have hit her arm at the 50mph she said I'd have broken it.

What I don't understand is my insurers want to send an assessor out to my car. It is modified and they are all listed but i'm not claiming and the police report says no damage to my vehicle.

When I spoke to my insurer they seemed confused.

UPDATE:-

Bad news, today I came home to an envelope containing a court summons.

Driving without due care.
Leaving the scene of an accident.
Failing to report an accident.

She has cooked up a witness with a rubbish story of overtaking on the wrong side of the road after the incident. An aquaintence this witness is.

How do I get a solictor involved? Do I do this through my car insurer or approach a solicitor?

I'm absolutely crapping myself. I could lose my job because of this.

Car insurance is your first port of call, if you have legal cover (i think). You need a solicitor to cross examine the witnesses to rat them out for the scumbags they are.

hopefully you could have a sort of character reference i.e someone like your boss who can vouch for you.

Whats the name of the person who you 'hit', could do some google fu on them.

Bummer - I can't help with your case, but wish you all the best in getting it sorted out.

I haven't read the whole post - was there any damage to your car? Any photos showing no damage?

Good luck mate.

Appoint your own solicitor. Don't use the free monkeys that you'll get with 'legal cover' on your car insurance. Look into your house insurance policy as that might provide cover for legal costs. Sometimes it excludes anything motor related but sometimes it doesn't.

My wife had an allegation made against her and getting a local, decent solicitor who knows the police and the magistrates paid dividends.

If what you are saying is true digitalwolf, then I sincerely hope that nothing further than court summons comes of this, you are found innocent and she has the book thrown at her.

Bloody hell :(

Did you actually hit her though? I can't see a clear answer on whether you did or not!

* Leaving the scene of an accident
* Not telling the police within 24 hours of having an accident.

each one 6-9 point min, and x hundred quid fine. better hope she doesnt have a witness. i got done in similar circumstances to you about 10 years ago.

Looks like I was right. Sucks to be you. My advice is to get a good lawyer. I had a similar non-accident as you and got the same summons but with dangerous drive. They later changed that to due care. In any case they did me for it, but given the circumstances reduced my fine and points.

This thread blows my mind.

Women walks in the road and you avoid her.

Women tries to say you hit her with no proof whatsoever and the police are just taking her word for it and ignoring the facts?

Total bull.

Hope everything goes ok for you mate as this women is out to screw you.

I'd love to see her reaction if she does get hit properly one day, that would teach her for tempting fate. Harsh but true.

Reading this thread makes me so angry its un real.

Get a good solicitor, win, get the book thrown at her.

Wish you all the best, can not believe this actually happens "I just found a witness" ofcourse you did you scum.

The facts are: the police have had a report of someone being hit and run and have someone who has made a statement. They also have another witness who has also made a statement. That is enough to let the court decide whether the allegation is false or not. Do you just expect the Police to ignore this evidence? The evidence may be completely fraudulent but it's not for the Police to decide, that's the court's job. The Police bashing is a bit tiresome when people don't understand the Police's actual role.

No way did I hit them, no damage to my car at all.

Best going with a local solictor then and not using my insurance?

I would go through the insurance company, this could be quite expensive and you'll need a good brief to get this all cleared up.

I am emotionally scarred, my best friend saw it happen.

Is this grounds for court? Really?
