So are you going to have to retake your driving test?

No, thank god, but if i had got the full 56 days ban my solicitor was waffling about re applying for a license or something.

By that time i was ranting in his car and not listening properly though so i didnt really understand what he was on about.

So erm, 2k fine, divide by minimum wage for their age, and voila, they have to do that many hours of (unpaid) work picking up rubbish from the street or risk jailtime instead.

Which is what they do anyway. Had a load of them clear out my alleyway a few weeks ago.
 
I seldom break the speed limit because im never normally out at 3am or on roads that allow it.

If you are asking if this is a deterrent then of course, its a reminder not to do it, but believe it or not this was a once off anyway.

Not being funny about it -I was just interested. I got 3 points 5 years ago - 35 in a 30 IIRC. I got them squashed with a speed awareness course, but for at least 2 years drove with more care and attention to speed. Clearly an additional £2,000 fine does focus the mind - does seem highly disproportionate. Mind you - at least you weren't that Swiss bloke from earlier this week...
 
Well that was a liberty this monrning.

2k fine, 42 day ban, 50 quid costs and 15 quid victim surcharge. Plus 400 quid my solicitor.

Victim my arse, the only victim here is me.

3am NOTHING except me and a copper on the motorway in a 1 year old Porsche, what the **** was i going to crash into.

No driving offences for 20 years to boot, that really has ****ed me off, 3 green grocer ****ers. Magistrates my arse.

You think it's down to the car? The Reason Mr_LOL got away with more I mean.

Not the car but your financial situation and if you need a car for your job/other people.

Someone could argue they need a car to take disabled person to hospital, kids to school or to keep a job.

It seems they felt Mark could do without his car for these things and that a 'standard' £300 fine wouldn't hurt him much.

Seems silly that other people can do much worse and get away with it.
 
I can only assume that you have been victimised for having a porsche and maybe taking a solicitor to a magistrates court.

I had to appear in court for speeding (I was on my way back from a top speed day at bruntingthorpe) and stupidly decided to see if I could beat my top speed on a public motorway using a sat nav as a speedo. Daft i know and no excuses.

The police car that got me could not keep up but did get my details on camera.

In short I got a CD10 (careless driving) on my licence 11 points (previous clean licence) and a £250 fine + police costs.

This was about 8 years ago. I was charged with doing in excess of 100mph when in fact i was doing much much more.

That was my only ever motoring conviction after crashing my first rear wheel drive car @ 19 and scaring my self silly I always kept speed to the track days.

But i was asked if i could afford the fine etc at the time which i could but was offered the option to pay it monthly.
 
Its an utterly disgusting punishment for the "crime" and I would be appealing immediately.

Two things wont have helped though, and these are putting down your real income, which is what got you hit with the big fine, and appointing a solicitor.

The way to beat the ****ers at their own game is to make it look like you are poor, and attend personally.

A bit of amatuer dramatics, and a very small declared income can ususally make these absurd fines go away.
 
What proof do they actually require for when you have to declare your income minus any deductions i.e. could you say I pay my sister £400 in cash a month to repay a loan she gave me and get away with it?
 
Are you thinking of appealing? What does you solicitor reckon would happen?

I think i mentioned in another thread, my mate went to magistrates to contest a using a mobile phone ticket. The way the magistrates and the clerk of the court talked to him was horrendous, he picked apart the policemans statement (wrong day on ticket, wrong licence plate, wrong street, description of phone incorrect etc) and all they kept saying was that they were transcription errors or errors made on the ticket whilst carrying out his duty and therefore they would overlook it. He wasnt allowed to ask many questions and when he did the magistrates told him that the copper had already answered those questions in his original statement and therefore didnt have to answer again. He also wasnt allowed to admit his mobile phone records as evidence as the magistrates said they could have been tampered with. He got 3 points, £500 fine and £500 costs (had to appear twice at court as original hearing didnt go ahead due to lack of time to hear case, for which he was charged the privelege of!).

He appealed and had his case heard in crown court and within 10 minutes it was thrown out as the evidence was inadmissable as the ticket details were so badly wrong (those transcription errors!) that the court wasnt willing to take it any further, they also reprimanded the CPS for even taking it to court in the first place. He got his fine/conviction quashed and got paid his costs.
 
Because shoplifters will just steal to pay the fine, so it'll just fuel the crime even further.

Shop lifters steal for themselves or to sell stuff on to make money... for themselves.

The courts usually would order repayment via deduction of benefits, therefore mitigating any need for people to steal to pay fines.

Well if that is true then they would still steal to replace the money that they are losing due to a reduction in benefits (if they were on benefits to begin with).
 
If i appealed it, it would cost me probably 1500quid for the solicitor and half a day with a barrister.

By the time it comes up the ban will be over, its just all geared so you dont bother.
