Amanda Knoxx retrial

well this is a bit awkward... the US rather unlikely to extradite if requested

does seem like a rather badly drawn treaty if one countries way of carrying out criminal trials like this is incompatible with the other... The Italians see this as all being part of the same trial rather than a second conviction after being found not guilty.

I'd also wonder what would happen in future should an American again be prosecuted for a serious crime in Italy and found not guilty on the first appeal - would they then be required to remain in the country due to the obvious flight risk while the prosecution appeals that verdict.
 
I have to agree that it's going to be a cold day in hell if Knox's gets extradited, the down side she's effectively stuck in the US for the rest of her life now. Which isn't all that awful as it's such a huge country.

I do wonder what countries if any she can travel to without fear of extradition?
 
From what I have read the extradition agreement cannot impose the US system of double jeopardy as a condition on any extradition request because in effect that would be imposing US law on the Italian system.

Could be worse, she could be stuck in the UK for the rest of her life....Now that would be purgatory.

I have a feeling the Italian justice system is as nuts as the Italian govmt. Just look at belacsoni. Would you trust a country that elected him with someone's freedom? I wouldn't.
 
Never understood the fascination with this case.

I recall first hearing details on the news and then thinking it was pretty much case closed when they caught Rudy Guede. Sadly no.

The Knox and Sollecito convictions appear to be a huge miscarriage of justice. There is little to no credible evidence that anyone other than Guede was involved.

Should have been a simple case without incompetent police and prosecutors. Instead, Guede, the man who can conclusively be demonstrated to have carried out the sexual assault and murder, gets his sentence reduced to 16 years on appeal and may be out sooner.

I got a proper bee in my bonnet about this case. Miscarriages of justice really do my head in.
 
The Italian Justice System is as corrupt and incompetent as its Political System. I doubt that they could demonstrate the necessary criteria to enable the United States to agree to Knox's extradition.

Some background on extradition. It all sounds pretty ambiguous, although I suspect if push comes to shove the US will give precedence to its own constitution and protected rights of its citizens over than of the US-Italian Treaty. It's how they normally react...it wouldn't be the first time the US has refused to extradite convicted (in Italian Courts) US citizens to Italy.

The system may be corrupt but it doesn't make the decision wrong, even a broken clock is right twice a day.
 
They only appealed it because she was in the states, they could save face by appealing, finding her guilty but her not actually having to go to jail.

It's pathetic, and he'll likely go to jail because he's not American. The lead prosecutor was the least competent and most unethical detective around pretty much, a complete moron. Everything points to one guy, he decides to try and spread the blame and hope for a lesser sentence, at which point they make up a load of rubbish that makes no sense then try to paint her as evil because she's, you know, had sex before and.........

If she was still there, or the extradition was rock solid, they wouldn't have done a retrial. Because basically she'd get the trial she deserves(like the first appeal) and be found not guilty. Saving face against the big US of A is more important than justice or common sense, and someone else gets to go to jail(most likely) because he's less important.

Politics/governments are a joke, Italy as a whole is a complete joke.
 
More interesting for me than the murder, is the upcoming political conflict regarding her extradition.

Pretty certain that she'll be staying in the States though.

It isn't much if a downside, she is a convicted murderer, twice. She's got away with a brutal murder, and actually managed to make herself look like the poor victim throughout.

I don't know how Italy is allowed to be in the EU when it's so corrupt. Recently their courts said that the military blew up the DC-9 airliner Itavia Flight 870 with a missile and demanded compensation for the families of the victims, but the official investigation proved that no missile was involved and it was actually a bomb that blew up the plane. So they effectively allowed a terrorist to go free after committing mass murder. :rolleyes:
