Probably, they will have expected this to happen. You can't just start suing people and not expect any backlash. I think they'll be covered.

Apple must have gone to market without a license for the Samsung 3g tech. Otherwise there is no way Samsung could even file a claim.

How the xxxx does apple have a case, just because it looks similar like pretty much every single tablet, mobile on the market unless your going by apples evidence which they changed so that it would look even more like an apple product.
Would you like Samsung, HTC etc. to design their products in a triangular shape, maybe a circular shape?
Think clothes designers should sue each other as well because there jeans, shirts etc. all look so similar, same goes for cars, motorbikes, TVs etc.

By the sounds of Samsungs case against apple for getting their products banned, that is what you call a decent legitimate case (especially if they got that patent long ago).

No doubt they are, all companies worry about the competition.
Though that doesn't seem to be the main reason behind this, I think they're more upset about being copied so blatantly and they'll use whatever patents they can to stop Samsung doing it. I strongly doubt Apple truly believe they have the right to the basic tablet design.
Whether you think the revised 10.1 is a copy of the iPad to some extent is entirely up to you, but it's certainly suspicious.
The same goes for the original Galaxy S. Samsung are silly though, it only counts against them.

For the 10.1 the only thing they changed was to make it thinner and lighter wasnt it?
Design wise it looks like any other android tablet to me more or less.
with the Galaxy S there is more of a case however its not exactly the same but they did clearly copy the design of the phone in some case.
Although no one hardly ever talks about how samsung innovate with there hardware, really great cpus, arguable the best screens around so they can clearly make up there own ideas, just silly they copied the design in the first place
