Apple vs Samsung, court orders Samsung to show Apple 5 new phones

Just wish Samsung had the financial stability to tell Apple to stop acting like ***** and cease providing Apple with parts for their iDevices... love to see where their nauseatingly named "Retina Display" would be without Samsung making it for them.

LG would just make it instead. ;)

What's wrong with the name? Does everything have to have a technical name? That just wouldn't appeal to people in general.
 
I think Apple have some very good patent officers that get this stuff through. Its not a case of what they patent, but how they do it.

It's not even that, it's just the system and apple despite what you guys think isn't the only ones which such patents. It's just the way it works, you apply your almost guaranteed to get it, it's then up to someone to take you to court and show why you shouldn't have that patent.

IMO is what should do is get an instant temporary one, which is then opened up to everyone. Anyone can lodge a complaint and patents office looks at the complaint and the patent and rules one way or another. Would cut down on court rules, would cut down on it taking 7 years to enforce genuine patents.


Also remember a lot of the patents apple have been granted, where actually filled years and years ago, so stating something had it 6 years ago means nothing if the patent was filed before that.

That's what I don't get. Samsung are a massive company, who own fab plants and apple are basically a very demanding customer.. Samsung itself I believe is a subsidiary company of a massive empire.. So I. Confused as Samsung parents could quite easily shut the whole joke down. Maybe they are just playing the game and burning them out?

You're confused because you don't really understand how business at this level works. Don't worry, you're not alone.

Interesting point. On the flipside does every feature Apple incorporate into their products have to have a new name at all? Video calling would be the most obvious example...

It all comes back to their genius marketing and their special target audience ;)

Because they have the means to simply drop apple out of the market and present a superior product to replace it. Apple must be paying them a lot!

... thats kind of the point. They've managed to convince joe public that they have invented pretty much everything on their iDevices because they've given it a "cool" name and marketed it well.

I'm not sure that was the case with Facetime. Most people knew about video calling when the iPhone 4 came out due to Skype, Live Messenger, etc.

Also, Facetime is a terrible name, they could have come up with something better than that. Even now it still sounds odd.

Care to elaborate? The way I see it is apple products are premium Samsung products sold at a massive mark up. Ios is far inferior to Android. Unless Samsung are getting a massive kick back, I just don't get it.

Thats only really been the case since Android 4 though (which is quite recent) - granted that gap may grow given iOS6 looks rather uninspired but it hasnt always been a bowl of roses in android land.
 
^^^ Agreed. Coming from HTC Desire which had Android 2.0.2 (IIRC) to Android 4 on the S3 - The OS is night and day.

I'll ignore this bit as it's uninformed, wrong and extremely biased.

There are many considerations:

Firstly, Apple and Samsung will have contracts in place. Samsung probably wouldn't be able to drop Apple quickly enough that they could really damage them, as Apple would be able to line up other suppliers in that time. Doing so, voiding these contracts, would cost them [Samsung] far more than they could ever afford.

Secondly, both Apple and Samsung are enormous companies. They have thousands of divisions dealing with all sorts of different things. Most of these people don't really care about the legal mumbo-jumbo that's going on behind the scenes. Ultimately all of this patent stuff has cost Samsung very little so far (except perhaps some hefty legal fees), a minuscule amount compared to what they would lose if they upset Apple in other areas (such as manufacturing agreements).

Thirdly, the only people really raging about Apple are the Android crowd. Google don't say much on the issue and don't seem hugely upset about it. They know that, no matter what Apple try and do, they can get around their patents and restrictions, it may just take some time. They're also confident in their software and their vision, Apple aren't upsetting that, and if Google continue with the positive progress they're making, they may well end up causing Apple a lot of trouble eventually (though this won't be for some time).

There is obviously a lot more than those points, but they're just a few examples.

I think some people such as yourself fail to grasp the somewhat trivial nature of all of this, patent disputes are a common part of business, all companies do it. Okay, Apple may be more aggressive, as well as getting the headlines because they're Apple, the worlds most popular/controversial/hated company.

Nobody would really care if it was Nokia having a little moan at LG about something.

Edit: Oh, and lastly, Samsung are probably making a FORTUNE out of Apple. Dropping them over a few patent disputes would cut off a massive source of income, are they really going to do that because some nerds are upset? Hell no.

More abrasive, wheres. That diagram someone posted. Some companies are suing and counter suing each other over 5000 patents, apple is small fry on the aggressive patent circuit.
 
I suspect the very first thing that was said by Apple lawyers to the Samsung ones was 'Anything in this case will not affect the deals previously signed for supply of components for any of our products. Agreed?'
 
I wouldn't dispute that patent wars are common in big business but it's the broad generic nature of Apple's patents, as well as the fact that many of them aren't even close to being created by Apple originally, even though their advertising would suggest otherwise.

I just see it like a company patenting being able to click icons to launch applications on a computer and then taking Microsoft to court.

And its that which is why Apple are becoming as despised as they are. Its true that many companies have very active legal teams playing the patent game but its the fact that Apple had the audacity and the brown paper envelopes to claim so many innovations that aren't their own (and get patent office agreements) that gets peoples back up.

Be that as it may, the only people currently upset about it are the 'Android geeks' (if you wish to call them that). Normally those people will try and beat Apple with the 'walled garden/Steve Jobs was evil' stick, but now they've got the patent stick, which is a bit bigger, and easier to swing.

If you ask someone in the street they'll either have no idea what you're talking about, or probably think it's because Apple did invent everything and that Samsung are copying them. :p
 
so a bunch of brain washed nubs then? :) doesn't make sense.. anyone with some sense will agree that this actually kills innovation :) its nothing to do with android or ios its just the stupidity of the patents that are granted.. its taking basic phone functions and then suing for them.. imagine bmw suing merc for using round wheels?!
