Apple vs Samsung, court orders Samsung to show Apple 5 new phones

so a bunch of brain washed nubs then? :) doesn't make sense.. anyone with some sense will agree that this actually kills innovation :) its nothing to do with android or ios its just the stupidity of the patents that are granted.. its taking basic phone functions and then suing for them.. imagine bmw suing merc for using round wheels?!

It creates legal problems that are usually worked out. It doesn't kill innovation. What innovation has it killed or even affected more than a tiny bit?

Anyway, I've already explained why this really isn't a big deal, it's being amplified by the Android fansites. I don't think it's much of a coincidence that the people who didn't like Apple to begin with just hate them even more now, people with no big interest in technology are oblivious to it or don't care, and I personally don't care either as I know it doesn't affect anything. I can't be bothered to hate or aggressively judge a company over something so relatively trivial... why would I? It just seems an entirely pointless waste of energy and effort.

If you don't like Apple, stop worrying about them. I have no real issue with them and think they make some nice gear (though less so at the moment), if you think it's naff, then it doesn't matter, it's not like the Android phone manufacturers are struggling to release phones or software updates, is it? It's made sod all difference.

Don't get me wrong, I'm not saying it's a good thing - in any market - but it happens, and it will keep happening. The car market isn't really comparable as it's far more diverse than a handful of phones, and the patent system won't be the same either.

The ultimate thing to blame is the system itself. If you ran a company and had the chance to try and affect major competitors, you'd probably end up doing the same thing. Google and co have probably tried as well, but failed as Apple seem to be more on the ball with patents.

Be that as it may, the only people currently upset about it are the 'Android geeks' (if you wish to call them that).

To be fair, I think part of the problem is that these "geeks" want the latest and greatest Android products which Apple are trying and, at times, successfully banning from certain markets meaning they cannot get these products....

It would annoy me if I had my heart set on a new product only for a competitor to have it banned as it is about to ship over some pretty pathetic stuff....

People do seem to be forgetting that Apple have lost or settled plenty of disputes too.

e.g having to remove push e-mail in Germany. The large case that were up against Nokia a couple of years ago now. The Chinese iPad case. The loss against HTC.

If you ask someone in the street they'll either have no idea what you're talking about, or probably think it's because Apple did invent everything and that Samsung are copying them. :p

I think that's a pretty major factor in the Apple hate for people who know better. Taking credit for other people's innovations is a pretty lame thing to do, whether you're a multinational corporation or just an average Joe. I know I shouldn't expect a company like Apple to act with morals but hey, I'm an idealist!

Last part stood out for me ;

Samsung later responded with its own filing, alleging that Apple was trying "to stifle legitimate competition and limit consumer choice to maintain its historically exorbitant profits".

Which is what's happening, and people can save the "It happens everywhere" lark.

If Samsung have nothing to fear, why even remove it in the first place?

If what many of you say/assume is all true, the prior art defence will squash all of this and Apple will end up out of pocket in the end.

The Android manufacturers/Google control enough patents to do some damage to Apple, if they could. Perhaps the ones they have are pretty rubbish, and they've patented everything the wrong way? Google don't seem willing to lift a finger and defend the likes of Samsung.

Also, what did you expect Samsung to say? "Oh, Apple think we copied them (because historically, they have), so they're now trying to mess up our sales - and not really succeeding. Whatever."

No, they're obviously going to try and spin it to make Apple look bad, but then, due to some people's dislike of Apple, they don't think of that.

Anyone find it amusing that the company that has pushed search forward like no other by been able to search billions of web sites in milliseconds isn't allowed to search it's own OS?

Well, they have to remove it on order of the court. I don't know enough about patent law to say whether or not the prior art defence will hold up but even if it does, Google/Andoid has still had it's name dragged through the mud for supposedly stealing Apple's idea. It's an extreme example but that's a bit like saying 'so what' if someone is wrongfully accused of being a paedophile, as long as they're found not guilty when it goes to court.

Apple are certainly much better at this patent game and of course, whoever granted their ridiculous patents are as much to blame but I do think the statement Samsung made about Apple stifling competition is completely true.

Imagine if Microsoft had patented such broad generic things in a computer operating system, would Apple even exist today if they had?

Bit OT but this seemed a decent place for this... From another forum but wanted to share it, made me laugh :D

I'm will buy the iPhone 5 when it is available because:
- it is an iPhone
- it is the best device
- Apple is the best company
- iPhone is more expensive than other devices so it has to be better
- Everyone has an iPhone
- All the Actors, Actresses and Entertainers have an iPhone
- the iPhone is heavy and built strong
- it has a lot of apps
- people wait on long lines for the iPhone so it has to be the best phone or people wouldn't wait on the long lines
- the iPhone is indestructible
- I want to support Steve Jobs.
- it has the Apple logo which looks cool, and people known that I am Hip
- having one shows I don't follow the crowds, and am able to make my own decisions.
- the iPhone has basically remained unchanged for years, so it must be the best device, as other manufactures keep changing their devices because they are subpar.
- it doesn't have a removable battery or SD card because it adds weight and it's better not to have them. It makes the iPhone more indestructible,
- when Apple decides it is in the best interest of their customers to do so, Apple will make changes to the iPhone.

If I think of any more Great reasons to own the iPhone. especially the Great iPhone 5, I'll be sure to post them.
I hope the above reasons haven explained why the iPhone is the Best, and helps others to make their decisions based on these Facts.
Thank you.

Not that I completely agree with it, but amusing!
