Inherent design flaw, so a straight forward warranty issue, even if Samsung try to claim otherwise. The fact they released a "fix" for it as well would prove beyond any doubt that it's an issue if you were forced to take them to court for a refund.

Looks like it's time to recommend people against getting their drives the way they're handling this.
What kind of grounds is a refund in order? Surely this product was broken from the beginning? And by the looks of things, isn't going to be fixed.
Fired off a support message to them. They better not say it's normal!
it depends whether the fault is fixable or not
ie a controller/fw bug or a design flaw with tlc nand
its obvious they will try to shrug it off
i think they will sort it out if enough complain,they did say they were looking into it so that's some hope
im glad i bought a pro,or id have two drives with issues,aint fired up my other pc for a few weeks so aitn had chance to test my evo,but last time i checked it was fine

However, all is not lost, because I`ve tested a more recent 840 EVO, and it's still performing as expected. There may have been a hardware update at some point which means that the problem is avoidable. Having said that, it may just be down to SSDs that have had more writes (usually older ones) still degrade, even with the recent firmware update

it was in one of those links,samsung replied saying we are looking into it
From my contact with them last time folks they sent out advance RMA's so I think they will handle this well once they know what is happening.
Patience.
My HD tune trial has expired, other wise I'd test mine.
