Bent CPU Pins?

(s)he hasn't set it up. Neither had I (didnt know what it was) but have now :)

Ive taken a screenshot myself just in case.

I had totally missed that! Just another piece of evidence to add to the already stacked amount :)

I got an email from eBay, after sending them about 3 or 4 myself, and they did say that they are taking note of what I have sent them. I will message them again stating this new evidence, as well as referencing the case number, so they know which case it is for.

I went to the police that day, and they said that at the moment it is not fraud, he is just 'trying' to commit fraud. They said that in the eventuality that eBay to side with him and I have to give a refund, then they can act, as long as he does anything other than send me back my board, in perfect condition as like when it was sent, with all accessories. So, if eBay side with him and I refund his money, if he either fails to return my item, that is theft, if he send my item back damaged, that is damage to property, or if he sends me a different item to the one I sent him, that is theft/fraud. They didn't say that exactly but that is essentially what they were implying. They didn't see the evidence I had but they said that with the amount of evidence I say I have if it does turn into a police matter I should have nothing to worry about and I should have a good case.

I can't believe how stupid this guy is, I really hope eBay side with me on this one, if they don't then they truly are a bunch of idiots. I hope they do as it would avoid all the extra hassle. If they don't I am tempted to go to the papers with this, 'eBay sides with scammers, don't give a crap about their sellers' :p

I hope this turns out in your favour without having to get the police involved. With the evidence you have on this scammer Ebay should side with you.

Guess you are learning your lesson the hard way and you will keeping clear of ebay in the future.
 
ask him for a better photo and get him to circle where he thinks the bent pins are, did you take down the serial number incase he sends you back a different broken one?
 
So why don't you get him to send the mobo back to you which he'd have to do anyway if he wants a refund. Then he's obviously got to send back the original that you sent him.
Not the supposed damaged one in his pic then you can prove that the one in his pic is not the one you sent him.
 
This happened to me, ebay took the money out of my paypal account and issued the refund before I got my motherboard back.
Luckily I was able to exchange it using the EVGA lifetime warranty but if I ever see the scammer, I will honestly rip his head off and **** down his neck.
Never use ebay as the amount of scammers outweigh the decent people that buy from it.
The scammers do it all the time and know how to get away with it.

because aslong as the buyer has tracking details of an item sent back to the seller thats all he needs to satisfy ebay to get a refund, could be an envelope of pubes for all they care.
 
Well the 10 days are up and today I escalated the case to eBay customer support. I re-wrote the entire explanation detailing how I know he is trying to scam me, stating I can provide evidence if necessary. I didn't want to bombard them again with all the links to the pictures so instead I referenced the case number for the report I filed against him over a week ago now.

A couple of hours later and I receive a massage from eBay:

Customer support has made a final decision and has asked the buyer to return the item to you for a full refund. 30 Apr, 2011 at 15:00
Final decision:
This case was decided in the buyer's favour.
Customer support comments:
For more information about this case, please refer to the email we sent you.
We passed this return information to the buyer.

Absolute 'base-tards', I don't think they even looked at the case at all. I am going to reply to the case I reported a week ago, as there they actually said they would take note of what I have sent them, and I will also contact the buyer telling him I have gone to the police on the matter and if I get anything other then my item returned to me in perfect condition as sent then they will be taking over the case.

A real pain in the rear, but I had a feeling eBay weren't going to listen.
 
That sucks, I would say something else I probably get banned for eternity!

How they come to that conclusion is beyond me :(

If he sends it back just tell them you received a box with something around the same weight as a motherboard in it (bottle of water?).

Two can play this game.
 
I agree with the above, if you're dealing with a crook, and there doesn't seem to be any reasonable recourse, then you may as well make things as difficult for him as possible.
