Looks like the same phone to me. He still doesn't understand what "excellent condition" means it would appear
Edit: it can't be as mine got back to him on the 12th. He's used the exact same description as the other phone though. Definitely a dodgy seller.

Get on to ebay/paypal. The refund is supposed to happen once the seller recieves it.
If you need to speak with eBay, I find that their live chat is most helpful - but it's pretty difficult to find! Here is a link to it: http://ocsnext.ebay.co.uk/ocs/cusr?query=1464&ref=1 - just click the blue "chat with us" button.

Yeah, get on Live Chat. Quote your dispute number if you have it at hand. They can force it in your favour after 30 days, as was said before.
