I don't think they did. They do believe that the Merc rear wing is flexing illegally though, it was that which Max was looking for.
Some rumours circuling say that the underside of the wing is flexing.

If you recall, the FIA introduced those spot marker reference datums to monitor wings flexing under load which is monitored by the onboard camera. Where does the camera have a blind spot? Underneath/behind the wing.
 
I do KNOW that but given the state of the championship you might think they might avoid controversy if they can...

Exactly, they want people talking about it as it potentially brings in more viewers and interest in the sport.
 
Apparently Redbull are trying to deflect this "legally" by arguing that since there was no stewards decision on this matter and therefore no incident or breach, how can an appeal take place on a non issue. So a fairly typical Redbull response, given they haven't got a leg to stand on otherwise.
