Car Hit by Drunk Driver

Question now is, would it be better to get my insurance to get things underway and recover costs from her insurance or go through her insurance?
Her insurance 100%, there won't be any fight from them because she was arrested for drink driving. They will be bending over backwards to get your car fixed.
 
Absolute rubbish. The insurance will pay for all third party damages.

Yes if the insurer can prove they intentionally drove while drunk, they don't have to cover them. It's the loophole and insurers love not paying.
 
Why did you add intentionally ? Everyone who drives drunk doesn’t do it by accident.

they may refuse to pay out to the policyholder for their damage but they legally have to pay third party damage.

Can you try to not invent stuff in 2020?
 
Nope, it's assumed it was an accident unless proven otherwise. Even with drunk drivers. They have to pay out to the other parties ofc but can get out of paying the drunk.

That is not true, an insurer is obliged to pay out to the third party. What they aren’t obliged to do is to pay for her repairs if she was fully comp and that the insurance company can reclaim the costs from her because she was drunk.
 
Sucks for you but at least she didn't hit someone could have so easily ended differently :(

Sorry to hear this mate... Some people make some stupid choices after a few drinks, hopefully they sort her out with some prison time... She could have killed someone, must have been doing some speed for the amount of damage to all the cars

On this note - I was at a Christmas party and there was another group on a works do one girl made it fairly clear she'd driven in and wasn't drinking - no one in the room really had an excuse IMO not to have picked up on it. Several of her colleagues were going "one drink isn't going to hurt" and stuff along that line and trying to ply drinks on her, etc. by the end of the night she was plainly in no state to drive but no one seemed to give a ****. Fortunately, as I was feeling a bit awkward about getting involved as I didn't know them, one of the other girls there eventually realised and got her mum to pick her up. Personally that ****** me off quite a bit.

My understanding would be the that the drunk drivers insurance is responsible to put him back to square one IE before the accident.
So they would need to provide him with enough cash to be able to go out and purchase a similar car that best matches his own.

So in this scenario why would the OP need their own GAP insurance?
 
DDs disgust me, hope she got a nice fat headache for her troubles - all these idiots should be given 3 years and then no driving ever again... especially if someones caught twice or thrice as does seem to happen.
Never allowing a DD to drive legally again might help with reducing the numbers that take the risk.
