Diplomatic Immunity


So, that coward Sacoolas has admitted causing Harry Dunn's death, and will be 'sentenced' at a later date.

Hang on:

Judge Mrs Justice Cheema-Grubb said Sacoolas, who was employed by a US intelligence agency, would be sentenced at the end of November.

The whole immunity thing was supposed because she was the family of an intelligence service employee, there was an oversight in the agreements whereby intelligence service employees were given immunity related to their work but their families had broad immunity.

If she's actually confirmed to be a current CIA employee, not just a retired one as seemed to be claimed earlier, then she shouldn't have been granted immunity for this and shouldn't have been allowed to leave surely?
 
I'm not expecting a custodial sentence tbh. The article did say the Dunns don't want to separate her from her children.

I wouldn't be of such lenient opinion if I were in their shoes.

Nor I. I'd want her in the UK, in one of our most secure prisons for her entire sentence. No early release based on the face that she could not bee monitored on licence & that she's a proven flight risk.
 
Looks like she will be getting some sort of jail term at least that's what the prospection are arguing for.

Ben Cooper KC tells the court that there is "strong mitigation" to reduce any sentence, including Mrs Sacoolas's conduct at the scene, her admission of full responsibility and the remorse she has expressed.

He says she surrendered to the criminal process. "Regrettably she has herself been subjected to extensive death threats."

Strange Ben Cooper overlooks the fact she run back the US several week after the incident

Hardly unexpected really.

I can appreciate the family wanted an official judgement made on the death of their son. But in reality the whole thing was a waste of time if the defendant can't be held to account for the crime.
Sometimes the judgement is enough and that seems to be what the family wanted at this point. I'm not really sure what greater punishment would have achieved? Nothing is going to bring the lad back and she will have to live with the knowledge of what she has done for the rest of her life.

Makes a mockery of our justice system.

The justice system is broken. My mum is a solicitor, she knows it's broken, they all do.

In this paticular case, well.....hardly worth bothering with was it. Eight months suspended for killing someone lol

She was charged with causing death by careless driving. Had it been death by dangerous driving the sentencing starts with a mandatory one year incarceration. Having said that I don't think it was dangerous driving - where the standard of driving falls far below what would be expected of a competent and careful driver and it would be obvious to a competent and careful driver that driving in that way would be dangerous.

I don't think the sentence is justice for Harry and his family, but it was never going to be jail time, the US authorities - who, remember, were responsible for whisking her out of the country - would never allow that.
 
Saw this outcome a long time ago. The family was never going to get any sort of "closure", because they wanted something that was never going to be possible despite what they've said. They should have taken up Trumps offer back then when the woman was in the other room if they wanted to confront them to get any sort of real closure as anything they did up till now would have still gone ahead anyway. Now they're just going to hate and seethe for the rest of their lives as they can't move on with this "token" result. :(
 
judge should have said that reform in diplomatic immunity law should be considered, and acknowledged judgement was predominately reflecting limitations it imposed,
equally that US would train personnel&families better (are devices in cars not possible now)

However, in actual reality:

Charlotte Charles said of the family's three-year wait for justice "we didn't back down because we have values".
Mrs Charles, Harry's mother, added that her "promise" to get justice for her son through the UK courts was "well and truly complete".
and
Mrs Charles added: "Anne Sacoolas has a criminal record for the rest of her life.

"That was something she never thought she'd see, something the US government never thought they'd see.

"Harry we done it. We're good, we're good."

Yup, I doubt she's ever going to come back to the UK, great some theoretical driving ban and theoretical prison sentence have been imposed, so basically nothing.

Realistically she seems to have been assured a lesser plea because of the practicalities, has been able to dodge appearing in person too for the same reason and I guess the sentence imposed is the result of them not being able to do anything either.

What really ought to be answered is who made the call to let her go and on what information? What did the civil servants advise Raab? It seems that if she was in fact working in the UK as an intelligence officer then the badly drafted agreement giving family members full diplomatic immunity doesn't apply; she should have been subject to a lesser immunity in relation to her work-related activities only, not her personal life.
