Utter tosh this is the exact reason why these big companies are still here they hope there are more people like yourself to bend over and take it. I got a result both times when i used small claims and it has nothing to with being a scammer or a moaner we pay over the odds in the uk as it let alone to be screwed over at warrenty time when you have done nothing wrong. I work hard pay my bills im be dammed if im getting done over just beacuse they have more money then me.

If it is still under warranty and the card has gone faulty you should be getting your full money back if they cannot replace with exact or a like for like model.

I've never come across such a SCAM like this one before. If scam doesn't want to help you get in touch with Consumer Direct the telephone number is on their website and see what they think about this.

I've worked in retail far too long and I have learn't that consumers are often worse than the retailers but in this case it is the other way around.
 
I have read about the same company trying the same line on someone returning a EOL Motherboard. In the end they got a full refund so I would suggest you stick to you guns and demand a refund in full. I would not even take an equivalent card personally.

Otherwise ask for the card returned and try to deal with XFX direct - after all a repair would be fine wouldn't it? Is the entire warrenty managed by the eTailer or just the first 12 months?

More deviously, XFX do allow warrenty transfers - xfer the warrenty to a mate and then XFX will have no choice but to deal with him as he has no relationship with the original eTailer to call upon, but still have a valid warrenty claim. Might work!
 
Contacted consumer direct, basically advised to keep negotiating with them.

Did they say anything with regards to whether the practise that scam are currently employing is legal or not? Also, what about if you do not get anywhere with scam what is your next course of action?

I wouldn't let this go becuase this is clearly wrong.

It might be worth contacting XFX and see where they stand with this after you explain what Scam are trying to do to you.
 
Look tell em you want a 285 as a replacement or you are taking them to small claims court.

Don't jump to the small cliams right away. I got this from so many customers. they were always bluffing. Retailers know this becuase it is a very time consuming process for the customer to go via small claims.

Keep on pestering them and asking to speak to people at the top, they'll give in finally and don't be rude or angry towards them, it doesn't help.

+1 this a very true my claims took between 3 months and 9 months to sort out so dont think it as easy cash or somthing....as said people use it all the time as a threat which is ignonred it when the summons lands they take notice lol

Hang in there mate it a very stressfull process and i wont be using them in future so worse case they lost a customer :)

dam im down to 3 trusted sites to order from...what ever happened to customer care
 
If you paid via credit card you can always try talking to them. Ultimatley they can perform a Charge-Back, refund you, and reduce the retailers credit worthiness.

Perhaps tell the retailer you will accept a lesser spec card such as a GTX 275 or 4890 if they clear things up immediately. Otherwise write them a formal letter of complaint informing them you will take matters further if they continue to flout your rights. Also explain that you are a member of many computing forums and will pass on your experirence of their service. Mentioning Watchdog may also help.
