Does this sound right (xfx rma)

During the duration of the limited hardware warranty, XFX or its authorized representative will repair any XFX-branded hardware products returned to us that prove to be defective in materials or workmanship. If XFX or its authorized representative is not able to repair the product, we will replace it with a comparable product that is new or refurbished.
When you contact us via phone or web, we will issue a Return Material Authorization Number for you to include with your return. You must return the products to us in their original or equivalent packaging with all original components, prepay shipping charges, and insure the shipment or accept the risk if the product is lost or damaged in shipment. We will return the repaired or replacement products to you. We will pay to ship the repaired or replaced products to you if you use an address in the United States (excluding Puerto Rico and U.S. possessions and territories). Otherwise, we will ship the product to you freight collect.
If we determine that the problem is not covered under this warranty, we will notify you and inform you of service alternatives that are available to you on a fee basis. If you want the product returned, you will have to pay the shipping fees.

XFX won't deal with you direct, same happened to me with another retailer where I buy performance kit.

They told me to go to XFX and not go through them, but XFX only deal with etailors not the public and I just kept badgering the supplier till I got an equivalent replacement card (this was a GTX260)

Keep pushing for a replacement as close to what you had as possible, which is a cheap Palit GTX285 or an XFX 275

Thank you Biffa, for your advice/input, im gonna keep at the supplier over this, a 2 year warrantied card failing within the first year is not good, theyre refund offer is an insult, £123.00 for a card that i paid £280.00 for, in my job (painter+decorator) we give every customer a 3 year moneyback guarantee, if a fault develops in the work weve done, we go back and make it right at no charge. Though with my graphics card issue, theyre totally blanking me, ive been more than polite in my communications and they still ignore me, ive explained how, during the rma i had to purchase another card to tide me over, just to keep my system running. This would have been ok a few months ago, but now due to lack of work i may be getting layed off next week and not in a position to afford a new high end graphics card.

Should you experience any difficulty obtaining a fair and proper warranty service from any of our Resellers please do not hesitate to contact us via the Support Ticketing System where we will do our best to help you.

Sounds like you should insist they discharge the warranty they hold from and that is underwritten by XFX.

I thought retailers were supposed to deal with the manufacturers too in case they can't deal with it with their own stock.
When I had to RMA an 8800GT card I was offered to either let the retailer give me back the purchase price minus something because it was already 3 or 4 months old ( it wasn't that bad, I only lost about 20€ from the orig price) or let them send it to asus for me to get a replacement.

Problem is, XFX isn't known for it's superb customer service, and this might take weeks...

It certainly is a joke, a £280.00 card with a 2 year warranty that fails in 10 months. If they cant sort it properly, the etailer and xfx will be companys ill refuse to use again, and reccomend others to do the same.

Got a reply from xfx support.

[PAULV - 2/1/2010 2:37:43 PM] Hi, thanks for your message and for letting us know. **** will credit you according to market value Robert, although you dont have to take the money at all, you are still entitled to a replacement should you wish, although unlikely they will be able to replace with the same model, they should still be able to offer a comparable product. Hope all goes well, however if any queries or problems please keep us posted. Kind regards Paul

This basically confirms that they should be able to offer me a comparable product.
